HomeMy WebLinkAboutA016 - Attorney's Opinion dated November 15, 2004 ATTORNEYS OPINION I,Deborah S.Krauth,hereby state that I am an Attorney at Law, duly admitted to the practice of law in the State of Iowa, and a member of the firm of Nyemaster, Goode, West, Hansell & O'Brien, with offices at 1416 Buckeye, Ste. 200, Ames, Story County, Iowa. I further state that I have examined the Abstract of Title to the following-described real estate, to-wit: PARCEL K IN THE NORTHWEST QUARTER(NW'/4) OF THE NORTHEAST QUARTER(NE'/4)OF SECTION 21,TOWNSHIP 83 NORTH,RANGE 24 WEST OF THE 5TH P.M., CITY OF AMES, STORY COUNTY, IOWA AS SHOWN ON PLAT OF SURVEY FILED ON JANUARY 30, 2004 IN THE OFFICE OF THE STORY COUNTY RECORDER AT INSTRUMENT NO. 04-01243 AND AT SLIDE 196, PAGE 3. from the root of the title thereof, down to and including the day of 2004, last certified by Abstract & Title Services of Story County (Iowa Title Guaranty Division Member#8650). The real estate has now been subdivided and is now known as SUNCREST SUBDIVISION THIRD ADDITION,AMES, STORY COUNTY,IOWA. Based upon information within said Abstract of Title, it is my opinion that the fee simple title to said real estate is in R. Friedrich and Sons, Inc. The real estate is free from encumbrances except for the following: 1. Mortgage dated May 1, 2004, executed by R. Friedrich and Sons, Inc., to First National Bank, Ames, Iowa, filed in the office of the Recorder of Story County,Iowa, on May 7, 2004, as Insttument No. 04-05744; And easements and restrictions of record and to zoning ordinances of the City of Ames, Iowa.
