HomeMy WebLinkAboutA002 - Attorney's Opinion + s ATTORNEY'S OPINION I,Deborah S.Krauth,hereby state that I am an Attorney at Law,duly admitted to the practice of law in the State of Iowa, and a member of the firm of Nyemaster, Goode, West, Hansell & O'Brien, with offices at 1416 Buckeye, Ste. 200, Ames, Story County, Iowa. I further state that I have examined the Abstract of Title to the following-described real estate, to-wit: That part of Parcel H in the Southeast Quarter of the Southwest Quarter of Section Eight(8)and Parcel F in the Northeast Quarter of the Northwest Quarter of Section Seventeen (17), all in Township Eighty-three (83) North, Range Twenty-four (24) West of the 5th P.M.,City of Ames,Story County,Iowa,more particularly described as follows: Beginning at the Northwest Corner of said Parcel H; thence S89°14'47"E, 1326.84 feet along the North line of said Parcel H to the Northeast Corner thereof;thence S00°55'52"E, 1322.15 feet along the East line of said Parcel H to the Southeast Corner thereof, also being the Northeast Corner of said Parcel F; thence S00030'30"E, 420.23 feet along the East line of said Parcel F to the Southeast Corner thereof,said point located on the Northerly right-of- way line of U.S. Highway #30; thence S89058'33"W, 436.33 feet along said right-of-way line;thence N8903 1'42"W, 196.72 feet along said right-of-way line to the beginning of a 3694.72 foot radius,non- tangent curve, concave Northeasterly; thence Northwesterly 639.75 feet along said right-of-way line and said curve having a chord that bears N83°33'49"W, 638.95 feet; thence N54001'47"W, 98.08 feet along said right-of-way line to the Southwest Corner of said Parcel F; thence N00°39'53"W, 310.14 feet along the West line of said Parcel F to the Northwest Corner thereof, also being the Southwest Corner of said Parcel H;thence N00°02'35"W, 1318.84 feet along the West line of said Parcel H to the Point of Beginning;containing 53.24 acres subject to easements and restrictions of record, from the root of the title thereof, down to and including the day of 0C-NZX7)Qr , 2004, last certified by Abstract & Title Services of Story County (Iowa Title Guaranty Division Member #8650). The real estate has now been subdivided and is now known as FOUNTAINVIEW SUBDIVISION,AMES, STORY COUNTY, IOWA. p63 e S Based upon information within said Abstract of Title, it is my opinion that the fee simple title to said real estate is in Hunziker Land Development Company, L.L.C. and Erben Hunziker and Margaret Hunziker Development,L.L.C.
