ITEM # a 1 • DATE 09/28/04 COUNCIL ACTION FORM SUBJECT: APPROVAL OF THE FINAL PLAT FOR FOUNTAINVIEW SUBDIVISION. BACKGROUND: The applicants, Erben Hunziker and Margaret Hunziker Development, L.L.C. are requesting that the Final Plat for Fountainview Subdivision be approved. The subject property consists of approximately 53.24 acres and is generally located on the south side of Mortensen Road, north of U.S. Highway 30, approximately one-quarter(Y4) mile east of South Dakota Avenue. The proposed Final Plat involves the creation of 22 platted lots, for multifamily residential development, five lettered outlots(Outlots 'A'—'E'), and one lettered lot(Lot'A')Outlots'A', 'B', and 'E' will be used for storm water and open space areas. Outlots 'C' and 'D' will be utilized for development entrance signage. Lot 'A' will be utilized for dedication as public street right-of-way for Seagrave Boulevard, Mayfield Drive, Walton Drive, and Maricopa Drive. The lots for multifamily residential development range in size from 35,350 square feet to 220,020 square feet. The net density of the proposed development will be determined at the time of site plan submittal for each of the platted lots. At this time, the developers have installed none of the required public improvements, including the underground utilities(water, storm sewer, and sanitary sewer), street paving, street lights, sidewalks, bike path, and street trees. Financial security in the form of a Letter of Credit in the amount of$1,273,242.00 has been submitted by the Developer for the cost of the underground utilities, bike path, street paving, and street lights. The sidewalks and street trees are secured through an Agreement for Sidewalk and Street Trees. These improvements will be installed as the individual lots are developed. As a result of this review, staff has determined that the Final Plat for Fountainview Subdivision should be approved. ALTERNATIVES: 1. The City Council can approve the Resolution of Partial Completion of Public Improvements and the Final Plat for Fountainview Subdivision. 2. The City Council can deny approval of the Resolution of Partial Completion of Public Improvements and the Final Plat for Fountainview Subdivision. 3. The City Council can refer these items back to staff and the developer for additional information. CITY MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Final Plat for Fountainview Subdivision.
