I, Amy L. Bentler, hereby state that I am an Attorney at Law, duly admitted to the
practice of law in the State of Iowa, and a member of the firm of Nyemaster, Goode, Voigts,West,
Hansell & O'Brien, with offices at 1416 Buckeye, Ste. 200, Ames, Story County, Iowa. I further
state that I have examined the Abstract of Title to the following-described real estate, to-wit:
Parcel B of Lots 6 and 7 and part of Lot 2, all in Camelot
Subdivision, Ames, Iowa, as shown on the "Plat of Survey"filed in
the office of the Recorder of Story County,Iowa,on August 22,2000,
and recorded as Instrument No. 00-09707 on Slide 78 at Page 4,
from the root of the title thereof, down to and including the 131h day of April,2004, last certified by
Batman-Sayers Abstract Company,Ames,Iowa(Iowa Title Guaranty Division Member#8212). The
real estate has now been subdivided and is now known as SAFARI SUBDIVISION, AMES,
STORY COUNTY, IOWA.
Based upon information within said Abstract of Title, it is my opinion that the fee
simple title to said real estate is in DICK CLEM COMMERCIAL PROPERTIES,L.L.C. The
real estate is free from encumbrances excepting,however, two mortgages in favor of First National
Bank, Ames, Iowa, dated January 3, 2000 and September 2, 1997 and filed January 4, 2000 and
September 4, 1997,in the office of the Recorder of Story County,Iowa as Instrument Nos.00-00104
and 97-09516,respectively,and easements of record and zoning ordinances of Ames,Story County,
Iowa.
