Box 811 Ames, IA 50010 Re: Mortensen Road and State Avenue Shared Use Trails Dear Steve, This correspondence is your approval to access University land along Mortensen Road and State Avenue for the construction of a shared use trail in the summer of 2006 with the understanding that the City of Ames concurs and agrees to the content of this letter. The areas of access are loi;ated on the north side of Mortenson Road, from Welch Avenue westerly to the institutional property limits, and along the west side of State Avenue from. Mortenson north to the institutional limits. The anticipated work will occur between July 25,2006 and October 30,2006. The City, or its contractor,will acquire utility locates and secure by fence any portion of the excavation that is open over night or accessible to the public. The City plans to have the contractor install silt fencing and restore the grade and seed the area with a lawn mix provided by the University. Other areas will be seeded by Story County with a native prairie seed mix following cons iletion activity. It is out understanding that this site will require a NPDES permit and the City will meet permit requirements. The university proposes the following terms as part of the operation 1) The University agrees to maintain this new path segment, which will include clearing snow, removing debris, and tree trimming. However, ISU will not commit to clearing the path of snow before 8:00 a.m. (With the closing of the Towers dormitorios, there is no longer ISU staff available to accomplish this task prior to 8:00 a.m. This time restriction might result in complaints from Middle School parents who find that the paths a:•e not cleared of snow in time when the students are going to school.) 2) The University agrees to share equally the cost with the City for any repairs or reconstruction to the path segments that are required in the future. 3) The City will be responsible for repair or replacement for any path signage.
