Hi,
I just spoke with Joel Thilges from FNB. He said that Keith would prefer to accomplish steps 1, 2, and 3
(red below) by the simultaneous paper shuffle method you talked about last week, rather than
sequentially. Keith would like to do this early next week.Would you be able to have whatever is needed
on our end to accomplish this?Joel is sending me a draft of the LOC tomorrow to review.

Subject Modifications for 500 Dotson(Outlot U,2nd Add)
Hi Keith,
Here are the preferred steps that we discussed:
• Submit a LOC for$175,100
• City releases 1st.position security on 500 Dotson
• Keith buys 500 Dotson
• Submit sketch plan/preliminary plat to DRC for 500 Dotson
• Modifications to agreement approved by Council
• Final Plat(s) submitted to DRC/approved by Council
Judy is drafting the modifications to the agreement; she should have this completed in a couple weeks, at
which time we'll meet with you and your lawyer. In general,this modification will:
• State that Pinnacle is responsible for only those provisions that apply to Outlot U (4)
Replace original agreement section V.13.3 (LW/Franklin provisions):
• Acknowledge Keith's LOC and current security interest in 3908 Marigold (Outlot R, 1st Add) as
the required security for the LW/Franklin developer obligation (2/5)
• Actual construction costs will be split 50% City/50% developer with the developers'share further
split 31% Pinnacle/69%Terra Firma (3)
• Construction shall be done when intersection falls below LOS 'C' or when a final plat is sought for
any part of 3908 Marigold (1)
The numbers in bold parenthesis correspond with the directives in the Council motion (minutes attached).
I will have our meeting scheduled for the week of Jan 21.
