I, Craig R. Hastings, hereby state that I am an Attorney at Law, duly
admitted to the practice of law in the State of Iowa, and a member of the firm of
Hastings & Gartin, LLP, with offices at 409 Duff, Ames, Iowa 50010. 1 further
state that I have examined the Abstract of Title to the following described real
estate, located in Story County, Iowa:
Lots 27, 28, 29, and 30, South Fork Subdivision, First Addition to
the City of Ames, Iowa
from the date of the root of title thereof, down to and including September 25,
2003, at 8:00 A.M., which abstract was last certified by Abstract & Title Services
of Story County., with Addendum by Abstract & Title Services of Story County
dated October 27, 2003. The real estate has been subdivided and is now to be
known as SOUTH FORK TOWNHOMES SUBDIVISION, FIRST ADDITION TO
AMES, IOWA.
Based upon information within the Abstract of Title, it is my opinion that
the fee simple title to said real estate is in SOUTH FORK TOWNHOMES, L.C.,
and that said real estate is free from all encumbrances excepting, however, the
following:
a. Memorandum of Agreement with City of Ames, Iowa, recorded August
17, 2001 as Inst. No. 01-11309.
b. Agreement for Public Improvements with City of Ames, Iowa, recorded
February 14, 2002 as Inst. No. 02-02604.
C. Agreement for Sidewalk and/or Bicycle Path and Street Trees with the
City of Ames, Iowa, recorded February 14, 2002 as Inst. No. 02-02603.
It is my opinion that the real estate is further subject to easements and
restrictions of record and the Zoning and Land Use Ordinances of Ames, Iowa.
