J Instrument prepared by: Deborah S.Krauth, 1416 Buckeye, Ste.200,Ames,IA 50010-8070; 515-232-3921 CITY OF AMES, IOWA RESOLUTION NUMBER 03-45 VACATING EASEMENTS AND ACCEPTING PLAT OF KINYON-CLARK SUBDIVISION FIRST ADDITION,AMES, STORY COUNTY,IOWA WHEREAS, it is necessary that the City of Ames vacate the following easements: A permanent easement 10 feet on both sides of a line more particularly described as follows: Commencing at the Northwest corner of the Southwest 1/4 of the Northeast 1/4 of Section 27, Township 84 North, Range 24 West, and running easterly along the North 1/4 1/4 line of said Section 27, a distance of 217.5 feet to the point of beginning;thence S 19°39'45"W 35 feet,thence S 2°07'45" W 572.5 feet,thence S 88°25'15"E 580.8 feet,thence S 1°52'15"W 289.4 feet to the South property line thereof; AND, A permanent easement 10 feet on both sides of a line more particularly described as follows: Commencing at the Northwest corner of the Southwest 1/4 of the Northeast 1/4 of Section 27, Township 84 North, Range 24 West, and running easterly along the North 1/4 1/4 line of said Section 27 a distance of 217.5 feet to the point of beginning; thence S 19°39'45' W 35 feet, thence S 2°07'45" W 572.5 feet, thence S 88°25'15" E 10 feet to the East property line thereof, as this land is being platted as a part of Kinyon-Clark Subdivision First Addition and new easements will be granted as a part of this subdivision, all pursuant to Iowa Code Section 354.23 in order to allow this plat to be accepted; WHEREAS,there has been submitted to the City Council of the City of Ames,Iowa, a plat of real estate described as: Pie 9 A replat of Parcels A,C,Q,and R,all in the Southwest Quarter of the Northeast Quarter of Section 27,Township 84 North,Range 24 West of the 5th P.M., City of Ames, Story County, Iowa, being more particularly described'as follows: Beginning at the Center of said Section 27; thence N00°00'14"E, 1263.78 feet along the west line of the Northeast Quarter of said Section 27 to the Northwest Corner of said Parcel Q, said point also being the Northwest Corner of the Southwest Quarter of the Northeast Quarter of said Section 27;thence N89°35'12"E, 256.08 feet along the north line of the Southwest Quarter of the Northeast Quarter of said Section 27; thence S 19°13'51"W, 48.27 feet; thence S70°46'09"E, 60.00 feet; thence N19°13'51"E, 5.93 feet to the beginning of a curve;thence northerly, northeasterly and easterly,39.28 feet along said curve having a radius of 25.00 feet, concave to the southeast, and a central angle of 90°01'l 3",and being subtended by a chord which bears N64°13'42"E, 35.36 feet; thence S70°46'09"E, 5.08 feet to the beginning of a curve tangent to said line; thence easterly, 78.86 feet along the curve concave to the north, having a radius of 230.00 feet, and a central angle of 19°38'38", and being subtended by a chord which bears S80°35'29"E, 78.47 feet; thence N89°35'12"E, 463.33 feet to the Northeast Corner of said Parcel C; thence S00°41'46"E, 811.74 feet along the east line of said parcels C and A to the Southeast Corner of said Parcel A; thence S88°46'38"W, 654.45 feet along the south line of said Parcels A and Q to the Northeast Corner of said Parcel R; thence S00°20'45"E, 379.31 feet to the Southeast Corner of said Parcel R;thence S88°44'17"W,234.15 feet to the point of beginning, containing 18.94 acres, which includes 0.18 acres of existing public right of way. to be known as KINYON-CLARK SUBDIVISION FIRST ADDITION, AMES, STORY COUNTY, IOWA, and WHEREAS, the City Planning Commission of the City of Ames, Iowa, has recommended that the plat be approved and dedicated property accepted, and WHEREAS, the owners of said real estate,Karine A. Clark and Karl B. Clark,wife and husband, and Doris L. Kinyon,have executed a written Consent and Dedication declaring that the platting is with its free consent and is in accordance with its desires as proprietor, and 2 WHEREAS, it is the opinion of the City Council of the City of Ames,Iowa,that the easements should be vacated, the plat should be approved and dedicated land accepted, WHEREAS,the notice of the hearing has been published and a hearing was held on vacating easements pursuant to Iowa Code Section 354.23; NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the following easements are vacated: A permanent easement 10 feet on both sides of a line more particularly described as follows: Commencing at the Northwest corner of the Southwest '/4 of the Northeast '/4 of Section 27, Township 84 North, Range 24 West, and running easterly along the North 1/4 1/4 line of said Section 27, a distance of 217.5 feet to the point of beginning;thence S 19°39'45"W 35 feet,thence S 2°07'45" W 572.5 feet,thence S 88°25'15"E 580.8 feet,thence S 1°52'15"W 289.4 feet to the South property line thereof; AND, A permanent easement 10 feet on both sides of a line more particularly described as follows: Commencing at the Northwest corner of the Southwest 1/4 of the Northeast 1/4 of Section 27, Township 84 North, Range 24 West, and running easterly along the North 1/4 line of said Section 27 a distance of 217.5 feet to the point of beginning; thence S 19°39'45' W 35 feet, thence S 2°07'45" W 572.5 feet, thence S 88°25'15" E 10 feet to the East property line thereof, and said real estate is by this resolution conveyed to the owners of said real estate; and BE IT FURTHER RESOLVED that the plat of KINYON-CLARK SUBDIVISION FIRST ADDITION,AMES,IOWA, be and it is hereby accepted and approved, and BE IT FURTHER RESOLVED that the dedication of Lots A, B and C within said street for public street services be and the same is hereby accepted for and on behalf of the City of Ames, Iowa, and that all of the acts of Karine A. Clark, Karl B. Clark, Doris L. Kinyon and R. 3 Friedrich and Sons, Inc., are hereby confirmed and approved by the City Council of the City of Ames, Iowa, on this 25th day of November , 2003.
