Since there is no"subdivision"file in the Clerks office, the City Clerk will have to decide how to file this. Will planning staff monitor this to be sure that the inspection staff do not issue certificates of occupancy before the sidewalks and street trees are in place? Can you think of a situation in which we would ever process a "Minor Subdivision to Council? We recently reviewed a site plan for construction of an apartment building on that parcel. Due to the existing property lines bisecting the site, the parcel needed to be replatted.As this is an infill project, the only public improvements needed were sidewalks. So, staff let the applicant record a plat of survey to consolidate the lots into one and we required the applicant to sign a sidewalk agreement to insure the installation of the sidewalks, as required by the subdivision regulations. We will make sure that they get a copy. Most times, if the proposed subdivision meets the criteria of a Minor Final Plat, staff will let the property owner file a plat of survey. However, often times we have a subdivision that meets the Minor Subdivision criteria, there are less than three lots and no public improvements other than sidewalk, street trees and/or bike paths, but, there may be a need to acquire easements, such as greenway, public utility, or cross-access easements. In those instances we use the Minor Final Plat procedure to insure that we get the appropriate easement documents. The Best Buy/Border's, Beach and Sunset, and Culver's Sites are examples. No sense in taking every minor subdivision to the City Council if it is not absolutely necessary. Does that sound reasonable? ecj Eric C.
