RE: Vacation of easement in Somerset
The Somerset Developers respectfully request that the public utility easement on the
North side of lots 22, 23, 24, 25, 26 and 27 in Somerset 13th Addition be vacated. There
are currently no utilities in this area and there are no plans to have any utilities in this area
in the future.
The reason for the need to vacate this easement is in part due to the Somerset
Development guidelines that require the porch or stoop to be built past the building
setback-line. On these six (6) lots, the ground slopes from the back to the front by almost
six (6) feet. This will require several steps to be built on the front of these properties.
Since the porch must encroach into the front yard it will cross over the public utility
easement.
We have visited with both the planning and zoning staff and the public works staff and it
is our belief that they are in agreement with this request.
