1 . I ITEM # DATE: October 28, 2003 COUNCIL ACTION FORM SUBJECT: APPROVING PARTIAL COMPLETION OF PUBLIC IMPROVEMENTS AND THE FINAL PLAT FOR SOMERSET SUBDIVISION THIRTEENTH ADDITION. BACKGROUND: The property owners, Erben Hunziker and Margaret Hunziker Development, L.L.C.; D. & R. Furman, L.L.C.; and R. Friedrich & Sons, Inc., are requesting approval of the Somerset Subdivision Thirteenth Addition. The subject area is a replat of Lots 1, 2, 45 — 58, 58A, 59 — 61, 61A, and 62, Outlots G, HH, A KK, and Lots B and E, Somerset Subdivision Third Addition, and Outlot H, Somerset Subdivision Ninth Addition. The subject area is..located on the south side of Northridge Parkway, west of Stange Road. The property owners are proposing to subdivide the subject property into 41 lots (Lots 1 —41)for single-family attached residential development, four outlots (Outlots WW, XX, YY, and ZZ), and three lots (Lots A, B, and C)for dedication as public right-of-way. Outlots WW and ZZ will provide areas for vehicular parking adjacent to the existing and proposed single-family attached residential units. Outlots XX and YY will be utilized as open space (The Horse Shoe Lawn and The Corner Lawn). Lot A will be dedicated as a local street (Northridge Lane). Lots B and .0 will be dedicated.as public alleys. Currently, Lot C is dedicated and partially improved as a local street (Eaton Avenue). As part of this Final Plat, this street (north of Bristol Drive) is being reclassified as a.public alley. There will be no direct vehicular access to the proposed lots from Northridge Parkway, Northridge Lane, Stange Road, and Bristol Drive. All vehicular access to the proposed lots will be via the public alleys. The entire area:of the Somerset Subdivision Thirteenth Addition includes 6.38 acres. The property is currently zoned "F-VR" (Village Residential). The proposed lots meet the requirements of the Zoning Ordinance. The developers have installed a portion of the required public improvements for this subdivision. The public improvements that have been completed include the installation of water, sanitary sewer, and storm sewer. Street (Northridge Lane), alleys, streetlights, sidewalks, and;street trees must still be installed. Street paving and streetlights are secured by a $.133,756.50 Letter of Credit and a Public Improvement Agreement. The sidewalks and street trees are secured through an Agreement for Sidewalk and Street Trees. These improvements will be installed as homes are constructed on the adjacent lots. As a result of this review, staff has determined that the Final Plat for Somerset Subdivision Fifteenth Addition should be approved. i S ALTERNATIVES: 1. The City Council can approve the Final Plat for Somerset Subdivision Thirteenth Addition. 2. The City Council can deny approval of the Final Plat for Somerset Subdivision Thirteenth Addition. 3. The City Council can refer the Final Plat back to staff and the property owners for additional information. CITY MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Final Plat for the Somerset Subdivision Thirteenth Addition. All subdivision requirements have been fulfilled.
