RESOLUTION NUMBER 03-444
VACATING EASEMENTS AND ACCEPTING PLAT
OF NORTHRIDGE HEIGHTS SUBDIVISION,
SEVENTH ADDITION,AMES, STORY COUNTY, IOWA
WHEREAS, it is necessary that the City of Ames vacate the following easements:
The Southerly 5 feet, Northerly 5 feet and the Easterly 5 feet of Lot
28; AND,
The Northerly 20 feet and the Easterly 8 feet of the Northerly 55 feet
of Lot 28,
as Lot 28 is being replatted and new easements granted as a part of this subdivision, all pursuant to
Iowa Code Section 354.23 in order to allow this plat to be accepted:
WHEREAS,there has been submitted to the City Council of the City of Ames,Iowa,a plat of
real estate described as:
A tract of land being an official replat of Lot 28, Outlot `O', Outlot
`P' and Outlot `Q' of Northridge Heights Subdivision, Sixth
Addition, City of Ames, Story County, Iowa, described as follows:
Beginning at the Northwest Corner of said Outlot `O'; thence
N89038'22"E, 1252.61 feet along the Northerly line of said Outlot to
the Northeast Corner thereof, thence continuing N89°38'22"E,
1312.61 feet along the Northerly line of said Outlot `P' to the
Northeast Corner thereof; thence S00°14'04"E, 1321.46 feet along
the Easterly line of said Outlot to the Southeast Corner thereof;
thence continuing S00°14'04"E, 1261.46 feet along the Easterly line
of said Outlot `Q' to the Southeast Corner thereof, a point on the
Northerly right-of-way line of Bloomington Road; thence
S89050'58"W, 26.97 feet along said Northerly right-of-way line to
the Southeast Corner of Northridge Heights Subdivision, Fifth

Corner of said Outlot, a point on the Easterly right-of-way line of
George Washington Carver Avenue;thence N00°41'37"W, 1289.25
feet along said right-of-way line to the Point of Beginning;containing
86.50 acres, subject to easements and restrictions of record.
to be known as NORTHRIDGE HEIGHTS SUBDIVISION SEVENTH ADDITION, AMES,
STORY COUNTY, IOWA, and
WHEREAS, the City Planning Commission of the City of Ames, Iowa, has recommended
that the plat be approved and,
WHEREAS, the owner of said real estate, Uthe Development Company, L.L.C., an Iowa
limited liability company, and Hanson Homes, Inc., an Iowa corporation, have executed a written
Consent and Dedication declaring that the platting is with their free consent and is in accordance
with their desires as proprietors, and
WHEREAS, it is the opinion of the City Council of the City of Ames, Iowa, that the
easements should be vacated and the plat should be approved,
WHEREAS,the notice of the hearing has been published and a hearing was held on vacating
easements encumbering Lot 28 of Northridge Heights Subdivision Sixth Addition, City of Ames,
Story County, Iowa, all pursuant to Iowa Code Section 354.23;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the following easements encumbering Lot 28,Northridge Heights Subdivision Sixth Addition,
City of Ames, Story County, Iowa are vacated:

28; AND,
The Northerly 20 feet and the Easterly 8 feet of the Northerly 55 feet
of Lot 28,
and said real estate is by this resolution conveyed to Uthe Development Company, L.L.C.; and
BE IT FURTHER RESOLVED that the plat of NORTHRIDGE HEIGHTS
SUBDIVISION SEVENTH ADDITION,AMES,STORY,COUNTY,IOWA,be and it is hereby
accepted and approved, and
BE IT FURTHER RESOLVED that the dedication of Lot `G', Public Street, (Wembley
Avenue, Preston Circle and Weston Drive) and Lot `H', Public Street(Harrison Road)within said
Northridge Heights Subdivision Seventh Addition for public street purposes be and the same is
hereby accepted for and on behalf of the City of Ames, Iowa, and all acts of Uthe Development
Company,L.L.C. and Hanson Homes,Inc.,are hereby confirmed and approved by the City Council
of the City of Ames, Iowa, on this 18th day of November , 2003.
