• q ITEM # Qe• • ' Z DATE 10/28/03 COUNCIL ACTION FORM SUBJECT: ACCEPTING PARTIAL COMPLETION OF PUBLIC IMPROVEMENTS AND APPROVAL OF THE FINAL PLAT FOR LONGVIEW SUBDIVISION SECOND ADDITION. 'BACKGROUND: The property owners, Erben Hunziker and Margaret Hunziker Apartments, L,L.C. are requesting approval of Longview Subdivision Second Addition. The subject property includes one existing outlot, which was platted as Outlot S, Dauntless Subdivision First Addition. The subject property is located on the north side of Mortensen Road, east of Miller Avenue. The property owner is proposing to subdivide existing Outlot S into 25 lots (Lots 1 —25)for single-family detached residential development, one outlot (Outlot P) for future residential development, and one lot (Lot D) for public street right-of-way. There will be no direct vehicular access from Mortensen Road to the proposed Lots 16-25. The entire area of Longview Subdivision Second Addition includes 13.10 acres. The property is currently zoned "RM" (Residential Medium Density District). Concurrently with this request, the property owner is requesting rezoning of the site from RM to "RL" (Residential Low Density District). The lots meet the requirements of the existing and proposed zoning. The developers have installed a portion of the required public improvements for this subdivision. The public improvements that have been completed include the installation of water, sanitary sewer, and storm sewer. Streets, streetlights, sidewalks, and street trees must still be installed. The streets and streetlights are secured by a $89,263.53 Letter of Credit and a Public Improvement Agreement. The sidewalks and street trees are secured through an Agreement for Sidewalk and Street Trees. These improvements will be installed as homes are constructed on the adjacent lots. As a result of this review, staff has determined that the Final Plat for Longview Subdivision Second Addition should be approved. ALTERNATIVES: 1. The City Council can approve partial completion of public improvements and the Final Plat for Longview Subdivision Second Addition. 2. The City Council can deny the partial completion of public improvements and approval of the Final Plat for Longview Subdivision Second Addition. 3. The City Council can refer these items back to staff and the property owners for additional information. CITY MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the partial completion of public improvements and the Final Plat for Longview Subdivision Second Addition. All subdivision requirements have been fulfilled.
