HomeMy WebLinkAboutA002 - Council Action Form dated October 14, 2003 i ITEM # Z a+ DATE 10/14/03 COUNCIL ACTION FORM SUBJECT: ACCEPTING PARTIAL COMPLETION OF PUBLIC IMPROVEMENTS AND APPROVAL OF THE FINAL PLAT FOR THE SOMERSET SUBDIVISION SIXTEENTH ADDITION. BACKGROUND: The property owners, Erben Hunziker and Margaret Hunziker Development, L.L.C.; D&R Furman, L.L.C.; and R. Friedrich & Sons, Inc., are requesting approval of the Somerset Subdivision Sixteenth Addition. The property in question includes two existing lots, which were platted as Outlot J, Somerset Subdivision Ninth Addition and Outlot M, Somerset Subdivision Twelfth Addition. Outlot J is located on the south side of Northridge Parkway, between Stange Road and Kent Avenue. Outlot M is located on the east side of Stange Road, north of the existing multifamily buildings located along the north side of Aspen Road, between Stange Road and Kent Avenue. The property owners are proposing to subdivide existing Outlot J into seven lots (Lots 1 — 7) for commercial development and one outlot (Outlot ZZ). Outlot ZZ will be a Paseo and will provide pedestrian access to the parking lot to the south. There will be no direct vehicular access to the proposed lots. All parking will be provided on the adjacent streets and in the common parking lot located directly south of the subject site. The property owners are proposing to subdivide existing Outlot M into one lot (Lot A)for right-of-way for Clayton Drive and one outlot (Outlot L), which will be further subdivided in the future for residential development. The entire area of the Somerset Subdivision Sixteenth Addition includes 10.38 acres.The property is currently zoned "F-VR" (Village Residential). The.lots meet the requirements of the Zoning Ordinance. The only public improvements to be installed with this Final Plat are the installation of public sidewalk and street trees along Northridge Parkway and the construction of 174 feet of Clayton Drive eastward from Stange Road to the eastern limits of Lot A. The applicant has submitted a Sidewalk and Street Tree Agreement to ensure the installation of the sidewalks and street trees. The applicant has submitted a letter of credit for$83,750.00 to ensure the construction of this portion of Clayton Avenue. As a result of this review, staff has determined that the Final Plat for Somerset Subdivision Sixteenth Addition should be approved. ALTERNATIVES: 1. The City Council can approve partial completion of public improvements and the Final Plat for Somerset Subdivision Sixteenth Addition. 2. The City Council can deny the partial completion of public improvements and approval of the Final Plat for Somerset Subdivision Sixteenth Addition. 3. The City Council can refer these items back to staff and the property owners for additional information. CITY MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the partial completion of public improvements and the Final Plat for the Somerset Subdivision Sixteenth Addition. All subdivision requirements have been fulfilled.
