RESOLUTION APPROVING ZONING AGREEMENT FOR
507 LINCOLN WAY
FOR THE CITY OF AMES,IOWA
WHEREAS, on September 24, 2019, the City Council held a public hearing and approved
the first reading of an ordinance to rezone 507 Lincoln Way from Downtown Gateway Commercial
(DGC)to Highway-Oriented Commercial(HOC)with a Master Plan with a condition that the owner
provide evidence of an agreement for the relocation of Starbucks and to sign a Zoning Agreement
prior to the third reading; and,
WHEREAS, City Council required the applicant to provide proof of a"written agreement"
that Starbucks would relocate to the 507 Lincoln Way site; and,
WHEREAS, the applicant had delivered to staff a signed Zoning Agreement with Master
Plan and a Letter of Intent(LOI)with Starbucks; and,
WHEREAS,the LOI is signed by the current property owner that leases to Starbucks at 327
Lincoln Way and a Starbuck's representative as the leasee; and,
WHEREAS,the future lease is predicated on the current property owners completing a land
swap for 507 Lincoln Way and 327 Lincoln Way; and,
WHEREAS, the LOI is not a lease in and of itself and is not a binding commitment; and,
WHEREAS,the Developer agrees that all development upon the Site shall be in compliance
with the Master Plan with a single point of access from Gilchrist Street and a single point of access
from Lincoln Way; and,
WHEREAS, the developer agrees that the allowable uses at the Site shall be restricted to
Office, Retail, and Entertainment, Restaurant and Recreational Trade uses; and,
WHEREAS, the Master Plan adopts a general conceptual plan for development, without
review or approval of specific subdivision plats or site plans for development of the Site; and,
WHEREAS, the Master Plan adoption does not anticipate or incorporate all the additional
approvals or requirements that may be required to properly and completely develop the Site and does
not relieve the developer of compliance with other provisions of the Ames Municipal Code,the Iowa
Code, SUDAS, or other federal, state or local laws or regulations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Zoning Agreement with Master Plan for 507 Lincoln Way is hereby approved.
