Home My WebLink About~Master - Setting Date of Public Hearing for Vacation of Sanitary Sewer Easement at 610 and 700 SE 16th Street DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Diane Voss,Ames City Clerk,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames Citv Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 19-554 RESOLUTION SETTING DATE OF PUBLIC HEARING FOR VACATION OF SANITARY SEWER EASEMENT AT 610 AND 700 SE 16TH STREET FOR THE CITY OF AMES, IOWA WHEREAS,the Final Plat for the Menard's Subdivision included an easement across 610 and 700 SE 161h Street for a sanitary sewer main extension that was anticipated to be installed as part of the new Menard's store construction; and, WHEREAS,during construction, it was determined that an existing raw water main was at an elevation that prevented the sewer from being installed as planned; and, WHEREAS, the sanitary sewer main extension was relocated farther to the west and a new easement was established and secured for that new sanitary sewer main location, and as a result the previously platted sewer easement is no longer needed and can be vacated; and, WHEREAS,pursuant to Iowa Code section 364.7,it is necessary to provide notice and a public hearing regarding the proposal of the City to dispose of its interest in this real property; and, WHEREAS, following notice and public hearing, the City will determine if this proposal is appropriate. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA, THAT: 1. Pursuant to Iowa Code section 364.7, publication of notice regarding the proposed vacation of a sanitary sewer easement and establishing a public hearing date regarding the proposal is required. 2. The public hearing regarding the proposal to consider vacation of the City's interest in a sanitary sewer easement at 610 and 700 SE 16`h Street,shall be held on November 12, 2019, at 6:00 p.m. 3. The City Clerk is hereby directed to provide notice of the public hearing as required by Iowa Code section 362.3. ADOPTED THIS 22"d day of October, 2019. Diane R. Voss, City Clerk John A.
