HomeMy WebLinkAbout~Master - Assessment of certain nuisance abatement for 1107 Grand Avenue CITY OF AMES, IOWA RESOLUTION NO. 19-552 Confirming amount of assessment for certain nuisance abatement actions at 1107 Grand Avenue BE IT RESOLVED by the City Council of Ames, Iowa: 1. The City Council has authority as described in Article III, Section 38A of the Constitution of the State of Iowa and in sections 364.12,364.13A, 364.13B,and 384.59 et seq. of the Code of Iowa, to declare and abate nuisances upon private property and to assess the costs incurred by the City for abatement actions. 2. By a decision dated February 6, 2017, the City of Ames Building Board of Appeals, ordered the abatement by demolition of a nuisance at 1107 Grand Avenue relating to a dangerous garage structure. After the failure of the owner to abate the nuisance, the City completed the action necessary to abate the nuisance. 3. The City expended $6,267.50 for the abatement of the dangerous structure. The City Clerk notified the property owner of the amount due and requested payment. Pursuant to Iowa Code section 384.59(1), after a public hearing, the City Council confirmed and fixed the proper assessment for the nuisance abatement at $6,267.50 on February 12, 2019, by Resolution No. 19-056. 4. Based upon the public records, the City Council determined that the valuation of the real property affected is as follows: a. Address: 1107 Grand Avenue b. Legal Description: Lot 6, Block 7 in Baird's Addition to Ames, Iowa. c. PIN: 09-03-234-070 d. Assessed Value: $176,500 5. On February 12, 2019, the City Council made a determination pursuant to Iowa Code section 364.13 that assessment shall be divided into ten(10)equal installments, as near as may be. Pursuant to Iowa Code section 384.60(1), the City Council further determined that all unpaid installments shall bear interest at the rate of 2.0% annually from the date of this resolution. 6. The City Council authorized and directed the finance director to prepare and the City Clerk to prepare and file in the office of the City Clerk an assessment schedule setting forth the description and parcel number of the lot to be assessed, the valuation of the lot as determined by the Council, and the amount to be assessed against the lot, all in accordance with Iowa Code section 384.59(1) and (2). 7. The City Council does hereby confirm and levy the assessments all as provided in the Assessment Schedule, attached hereto as Exhibit A as if set out fully. There is no conditional levy of the amount of deficiencies which may be subsequently assessed against each lot under section 384.63. The assessments shall be payable upon certification to the County Treasurer. 8. The clerk shall certify the final schedule to the County Treasurer of the county and publish notice of the schedule once each week for two consecutive weeks in the manner provided in section 362.3, the first publication of which shall be not more than fifteen days from the date of filing of the final schedule. 9. The City Clerk is authorized and directed to mail notice to the property owner on or before the date of the second publication of notice, and as provided in Iowa Code section 384.60(2). the property owner shall be advised that any such assessments may be paid in full or in part without interest within 30 days after notice of the final assessment schedule, such payments to be made at the office of the City of Ames Finance Department, 515 Clark Avenue, Ames IA 50010. 10. The first installment of the unpaid assessment shall be due and payable at the office of the County Treasurer of Story County on the first day of July 2021, and shall become delinquent after the first day of October, following the due date, including those instances when the last day of September is a Saturday or Sunday, and will draw additionally the same delinquent interest as ordinary taxes. 11. Succeeding installments shall become due and payable in the like manner on the first day of July in each of the succeeding nine years, 2022 through 2031, inclusive. 12.The City Council finds this resolution appropriate and necessary to protect, preserve and improve the rights privileges, property,peace, safety,health, welfare,comfort,and convenience of the City of Ames and its citizens, all as provided for in and permitted by section 364.1 of the Code of Iowa. 13. All other resolutions or parts of resolutions in conflict with this resolution are hereby repealed. If any part of this resolution is adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the resolution or action of the City Council as a whole or any part thereof not adjudged invalid or unconstitutional. This resolution shall be in full force and effect from and after the date of its approval as provided by law.
