RESOLUTION NO. 19-542
RESOLUTION APPROVING VACATION OF PUBLIC UTILITY EASEMENT
FOR 2812 HYATT CIRCLE
FOR THE CITY OF AMES, IOWA
WHEREAS,there is an existing Public Utility Easement along the former east property line on
the property located at 2812 Hyatt Circle; and,
WHEREAS,in 2018,a Plat of Survey to adjust the east property line of 2812 Hyatt Circle was
submitted, approved, and recorded; and,
WHEREAS,pursuant to Iowa Code Section 364.7, notice was given on September 24, 2019,
and a public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the public utility easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The existing Public Utility Easement across the following described land is hereby
vacated:
Five (5) foot wide Public Utility Easements (PUE) adjoining the east and west side of
the boundary line between Lots 10 and 11 in the Ames Community Development Park Fourth
Addition, City of Ames, Story County, Iowa, with it terminus ten(10) feet south of the north line of
said Lot 10 and five (5) feet north of the south line of said Lot 10.
ADOPTED THIS 8'day of October, 2019.
