RESOLUTION NO. 19-502
RESOLUTION SETTING DATE OF PUBLIC HEARING FOR
VACATION OF PUBLIC UTILITY EASEMENT
AT 2812 HYATT CIRCLE
FOR THE CITY OF AMES,IOWA
WHEREAS,the owner of 2812 Hyatt Circle is Prestage Farms of Iowa LLC,and in 2018,a Plat
of Survey to adjust the east property line was submitted, approved, and recorded; and,
WHEREAS, according to the Plat, the existing public utility easement(PUE)along the former
east property line may be vacated; and,
WHEREAS,the Plat also established a new Public Utility Easement five feet on either side of
the revised east property line to replace the Public Utility Easement to be vacated; and,
WHEREAS, utility companies have been contacted regarding the proposed vacation of this
existing Public Utility Easement and no objections or negative impacts from this change were indicated;
and,
WHEREAS,pursuant to Iowa Code Section 364.7, it is necessary to provide notice and hold a
public hearing regarding the proposal of the City to dispose of its interest in this real property; and,
WHEREAS, following notice and public hearing, the City will determine if this proposal is
appropriate.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES, IOWA, THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of a public utility easement and establishing a public hearing date regarding the
proposal is required.
2. The public hearing regarding the proposal to consider vacation of the City's interest in
a public utility easement at 2812 Hyatt Circle shall be held on October 8, 2019, at
6:00 p.m.
3. The City Clerk is hereby directed to provide notice of the public hearing as required by
Iowa Code Section 362.3.
