RESOLUTION NO. 08-029
RESOLUTION APPROVING REQUEST FOR WAIVER OF SUBDIVISION
REQUIREMENTS FOR OUTLOT H, GENE HARRIS SUBDIVISION, 2ND ADDITION,
BOONE COUNTY,
FOR THE CITY OF AMES, IOWA
WHEREAS,on December 18,2007,the City Council referred to staff a request from the attorney
representing PowerFilm, Inc., to waive of subdivision standards for property designated as Outlot H,
Gene Harris Subdivision, 2nd Addition, in Boone County; and,
WHEREAS, the applicant is now proposing to split Outlot H, which is located inside the two-
mile jurisdiction of Ames, into two parcels with access to and frontage on public right-of-way; and,
WHEREAS,fringe planning for this area is not yet complete,but the City is not likely to annex
land along this corridor in the immediate future, and is engaged in cooperative urban fringe planning
with Boone County; and,
WHEREAS,in reviewing past subdivisions involved in rural development,the City of Ames has
required property owners to sign and provide covenants waiving the right of whomever owns the
property to protest future assessments for public improvements and binding property owners and future
owners to pay the full cost of abandoning rural water systems in the future; and,
WHEREAS,this particular parcel is part of a previous subdivision waiver request,and covenants
are already in place for the subject property; and,
WHEREAS,without a waiver,of infrastructure requirements,the property owner must provide
streets, sanitary sewer, and water systems meeting City standards even though the City has not yet
extended infrastructure to this site; and,
WHEREAS, earlier subdivision requests of this nature have been granted with conditions that
provide for efficient and orderly expansion of the City in the future.
NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames, Iowa,that
the request for waiver of subdivision regulations for the installation of public improvements for
Outlot H, Gene Harris Subdivision, 2"Addition, Boone County, is hereby approved.
ADOPTED THIS 22°d day of January, 2008.
