I have examined the abstracts of title for the following described real estate:

AREPLAT OF LOTS 1,2,AND 3 IN COLLEGE HEIGHTS SECOND ADDITION,AND
PART OF LOTS 10 AND 11 IN THE NE 1/4 OF THE NE 1/4 OF SECTION 9-83-24,ALL
IN THE CITY OF AMES, STORY COUNTY, IOWA.
Survey Description- College Heights Third Addition
Lots 1, 2 and 3 all in Block 1, College Heights Second Addition to Ames, Iowa; and
the North 60.00 feet of the East 143.00 feet of Lot 11 in the NE 1/4 of the NE 1/4 of
Section 9,Township 83 North,Range 24 West ofthe 5th P.M.,Iowa;and Beginning
at the Southeast Corner ofLot 10 in the NE 1/4 of the NE 1/4 of Section 9,Township
83 North, Range 24 West of the 5th P.M., Iowa; thence North 55.00 feet; thence
West 129.55 feet; thence South 55.00 feet; thence East 129.25 feet to the place of
beginning; AND; Parcel 'D': Part of Lot 10 in the Northeast Quarter of the Northeast
Quarter of Section 9, Township 83 North, Range 24 West of the 5th P. M., in the City of
Ames, Story County,Iowa,as described in a Plat of Survey filed for record in the Office of
the Story County Recorder on the 26'day of February, 2003,at Instrument No. 03-03723
and recorded on Slide 157,at Page 6.
as last certified by Ann Breeding, President of Iowa Title Company, Abstract No. 64359-2A on
November 7,2002 with the Addendum being dated March 3,2003 and as further amended on March

Based only thereon, I find the prevailing record title to the above described real estate(hereinafter
called the "Property")to be in 121 Beach LLC, an Iowa limited liability company, by virtue of a
Warranty Deed dated March 31, 2003 from Commercial Federal Bank and by virtue of a Warranty
Deed dated March 31, 2003 from Pi Kappa Alpha Union, subject to a mortgage in favor of First
American Bank, Ames, Iowa, easements for public right of ways, City of Ames Iowa zoning
ordinances and regulations, and regular real estate taxes.
