ELECTRIC UTILITY EASEMENT
KNOW ALL PERSONS BY THIS INSTRUMENT that the undersigned,121 BEACH LLC,(hereinafter
"Grantor') hereby grants the CITY OF AMES, IOWA, (hereinafter "City') the perpetual right to the
following described easement:
Underground Electric Utifily Easements. Grantor grants to City,the right to construct,reconstruct,maintain
and use its electric lines, consisting of underground cables,fixtures, anchors and other similar equipment or
any part thereof,and pad mounted transformers,switches and pedestals, upon,under and across the following
described real estate situated in Ames, Story County, Iowa:
Underground Electric Easement Description:
Part of Lot 1 in College Heights Third Addition, City of Ames, Story County,Iowa,more
particularly described as follows; Beginning at the Northeast Comer of said Lot 1;thence
N89°23'15"W, 129.30 feet along the north line of said Lot 1;thence S00°02'49"E,5.00 feet;
thence S89°23'15"E, 124.29 feet;thence S00°00'04"W,55.00 feet;thence S89°23'15"E,5.00
feet to a point on the east line of said Lot 1;thence N00°00'04"E, 60.00 feet along said east
line to the Point of Beginning,containing 0.02 acres,and;Beginning at the Southeast Comer
of said Lot 1; thence N00°00'04"E, 10.00 feet along the east line of said Lot 1; thence
N89°17'36"W, 132.98 feet;thence N00°32'57"W, 99.48 feet;thence N89°22'47W, 10.00
feet; thence S00°32'57"E, 109.46 feet to a point on the south line of said Lot 1; thence
S89°17'36"E, 142.89 feet along said south line to the Point of Beginning, containing 0.06
acres.
In an emergency situation,Grantor grants City the right to construct temporary overhead facilities within the
above described easements upon the condition that such facilities will be removed as weather permits.
Electric Utility Easement: Grantor grants to City the right to construct reconstruct, maintain and use its
electric lines,consisting of poles,wires,overhead cables,fixtures,anchors and other similar equipment or any
part thereof,upon, over,under or across the following described real estate situated in Ames, Story County,
Iowa:

Part of Lot 1 in College Heights Third Addition, City of Ames, Story County, Iowa,more
particularly described as follows; Beginning at the Northwest Comer of said Lot 1;thence
S00°32'57"E, 10.00 feet along the west line of said Lot 1;thence S89'22'47"E, 124.70 feet;
thence N00°32'57"W, 10.00 feet; thence N89'22'10"W, 5.22 feet; thence N00°02'49"W,
54.51 feet to a point on the north line of said Lot 1;thence N89'23'15"W, 15.00 feet;thence
S00°02'49"E, 54.51 feet; thence N89'22'47"W, 104.48 feet to the Point of Beginning,
containing 0.05 acres.
Grantor,its successors and assigns,reserves the right to construct parking lots or drives on the above described

easement; to construct sanitary sewer, electric, gas, telephone and/or other telecommunication utilities or
perpendicular storm,sanitary or gas utilities within the above described easements providing such use does not
interfere with the electric cables constructed by the City of Ames.
The foregoing rights are granted upon the express condition that the City will assume all liability for all
damages to the above described property in its use or maintenance of the electric utility easements or caused
by the City's failure to use due care in its exercise of the rights granted herein. The City further agrees to
restore all changes caused by City endeavors back to their original condition.
