HomeMy WebLinkAboutA002 - Council Action Form dated December 10, 2002 ITEM # U a ib DATE 12/10/02 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING THE FINAL PLAT FOR WESTWOODS PLAT 3, LOCATED AT 2226 AND 2227 29T" PLACE, OUTSIDE THE CITY'S CORPORATE LIMITS IN BOONE COUNTY, AND WITHIN THE TWO-MILE JURISDICTION OF THE CITY OF AMES, CONTAINING APPROXIMATELY 27.19 ACRES,AND A RESOLUTION APPROVING THE COVENANT FOR ASSESSMENT OF COSTS OF IMPROVEMENTS. BACKGROUND: Request. The property owner is requesting that the Final Plat for Westwoods Plat 3 be approved. Proposed Subdivision. The proposed subdivision, including approximately 27.19 acres, is located outside the corporate limits of the City of Ames, in Boone County, but within the two-mile jurisdiction area of the City. The address of the property is 2226 and 2227 29tn Place. The proposed subdivision is a resubdivision of Lots 3, 5, 6, & 7 of Westwoods Plat 2, Boone County, Iowa. The Final Plat for Westwoods Plat 2 divides the subject property into 10 commercial lots (see the attached Final Plat), that range in size as follows: • Lot 1: 2.10 acres; • Lot 2: 2.07 acres; • Lot 3: 2.06 acres; • Lot 4: 2.06 acres; • Lot 5: 3.88 acres; • Lot 6: 3.87 acres; • Lot 7: 3.86 acres; • Lot 8: 3.86 acres; • Lot 9: 1.42 acres; and, • Lot 10: 2.00 acres. Lots 1 through 10 have frontage on an existing public access easement granted to Boone County. Zoning. The Boone County zoning designation on property in the proposed subdivision is "C-1" (Commercial). • 7 L 1 Covenant for Assessment of Costs of Improvements. On June 11, 2002, the Ames City Council passed a resolution approving a waiver of the requirements in the Subdivision Ordinance for the installation of public infrastructure, with the following stipulation: • That the property owners sign an agreement, prior to consideration of the Final Plat by the City Council, to waive their rights to appeal future assessments for public improvements. The property owners have signed the "Covenant for Assessments of Costs of Improvements",which waives their rights to appeal future assessments. It is necessary, as part of the approval of the Final Plat, that the City Council approve this agreement for signature by the Mayor. Staff believes all stipulations of the Preliminary Plat approval have been met and recommends approval of the Final Plat for Westwoods Plat 3. ALTERNATIVES: 1. The City Council can approve the Final Plat and the Covenant for Assessment of Costs of Improvements for Westwoods Plat 3. 2. The City Council can deny approval of the Final Plat and the Covenant for Assessment of Costs of Improvements for Westwoods Plat 3. 3. The City Council can approve the Final Plat and the Covenant for Assessment of Costs of Improvements for Westwoods Plat 3, with modifications. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Final Plat and the Covenant for Assessment of Costs of Improvements for Westwoods Plat 3. All subdivision requirements have been fulfilled.
