HomeMy WebLinkAboutA003 - Council Action Form dated March 4, 2003 s - 5 ITEM # 1® DATE 03/04/03 COUNCIL ACTION FORM SUBJECT:APPROVAL OF PARTIAL COMPLETION OF PUBLIC IMPROVEMENTS AND THE FINAL PLAT FOR DAYTON PARK SUBDIVISION FOURTH ADDITION. BACKGROUND: The applicants, Dayton Park, L.L.C., are requesting that the Final Plat for Dayton Park Subdivision Fourth Addition be approved. The subject property consists of 37.20 acres, generally located at the intersection of South Bell Avenue and Southeast 16th Street. The proposed Final Plat involves the creation of three platted lots. Two lots are planned for industrial development and one lettered outlot, Outlot'W', is planned forfuture industrial development. The entire area of the Dayton Park Subdivision Fourth Addition includes 32.20 acres. Outlot 'W' includes 29.54 acres. Lots 1 and 2 consist of approximately 2.63 and 5.03 acres respectively. The developers have installed a portion of the required public improvements for this subdivision with.previous additions. The public improvements that have been completed include the installation of water(along South Bell Avenue), sanitary sewer, curb and gutter, sidewalks on the west side of South Bell Avenue (the requirement to install sidewalk on the east side of South Bell Avenue was waived by City Council), and street surfacing. Storm sewer must still be installed. The storm sewer improvement is secured by a$51,420 Letter of Credit and a Public Improvement Agreement. A condition of approval of the existing Preliminary Plat for this area was the requirement for the developer to extend the 12" water main from the corner of South Bell Avenue and Southeast 16th Street to the eastern edge of the subdivision, along the southern boundary of proposed Lot 1. Previously, it was thought that the water main would be extended under Interstate 35 at this location. This location is essentially the widest portion of interstate right-of-way, which contains the full, cloverleaf interchange for U.S. Highway 30 and Interstate 35. Upon further review, staff believes that extending the water main under Interstate 35 at this location will be difficult if not impossible. The Federal Highway Administration may not even allow utilities to be extended under a full, cloverleaf interchange. Regardless, the distance that the water main would have to be extended (most likely bored) under Interstate 35, makes this extension very costly. Staff believes that there is a more cost-effective alternative. As properties to the north of this subdivision develop, there will be opportunities to extend a water main across Interstate 35, slightly further to the north where the interstate right-of-way is much narrower. Therefore, the extension of a water main across the interstate at that location would be less expensive. Staff believes that the condition requiring the developer to extend the 12" water main to the eastern edge of the subdivision, along the southern property boundary of proposed Lot 1, is not needed. The water main will be extended at such time as the properties to the north develop. As a result of this review, staff has determined that the Final Plat for Dayton Park Subdivision Fourth Addition should be approved. ALTERNATIVES: 1. The City Council can approve the Resolution of Partial Completion of Public Improvements and the Final Plat for Dayton Park Subdivision Fourth Addition. 2. The City Council can deny approval of the Resolution of Partial Completion of Public Improvements and the Final Plat for Dayton Park Subdivision Fourth Addition. 3. The City Council can refer these items back to staff and the developer for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Resolution of Partial Completion of Public Improvements and the Final Plat for Dayton Park Subdivision Fourth Addition. All subdivision requirements have been fulfilled.
