` ITEM # DATE 01/14/03 COUNCIL ACTION FORM SUBJECT: A RESOLUTION APPROVING THE PARTIAL COMPLETION OF PUBLIC IMPROVEMENTS IN SOMERSET SUBDIVISION TWELFTH ADDITION AND A RESOLUTION APPROVING THE FINAL PLAT FOR SOMERSET SUBDIVISION TWELFTH ADDITION. BACKGROUND: The applicants, Erben Hunziker and Margaret Hunziker Development, L.L.C.; D & R Furman, L.L.C.; and R. Friedrich & Sons, Inc., are requesting that the Final Plat for Somerset Subdivision Twelfth Addition be approved. The subject property consists of 26.337 acres, generally located north of Aspen Road and east of Kent Avenue. The proposed Final Plat involves the creation of 42 platted lots. Thirty-six (36) lots are planned for single-family detached residential development, six (6) lots are planned for multiple-family residential development, three lettered outlots (Outlots 'XX', 'YY' and 'ZZ') are planned for open space development, another lettered outlot(Outlot'M') is planned for future single-family detached residential development, and four lettered lots (Lots 'A', 'B', 'C', and 'D') will be dedicated for public street right-of-way for Kent Avenue, Kingston Avenue, Somerset Avenue, and Clayton Drive. The entire area of the Somerset Subdivision Twelfth Addition includes 26.337 acres. Outlot 'M' includes 9.989 acres. Outlots 'XX', 'YY' and 'ZZ' consists of approximately 0.84, 0.73, and 0.10 acres respectively. Lots 'A', 'B', 'C', and 'D' consist of approximately 0.84, 0.65, 0.62,.and 0.88 acres respectively.The remainder of the subdivision,which includes Lots 1 through 42, includes approximately 11.65 acres. The lots for single-family detached dwellings range in size from 7,842 square feet to 12,510 square feet.The net density of the proposed single-family detached is 4.40 dwelling units per net acre, based on 36 lots on 8.18 net acres. The lots for multiple-family dwellings range in size from 22,786 square feet to 30,351 square feet. The density of the multiple-family developments will be reviewed at the time site plans are submitted and approved for each individual lots. The developers have installed a portion of the required public improvements for this subdivision. The public improvements that have been completed include the installation of water, sanitary sewer, storm sewer, curb and gutter, and street surfacing except the top coat of asphalt. Pedestrian/bike paths, top coat of asphalt surface for the streets, streetlights, sidewalks and street trees must still be installed. The pedestrian/bike paths, top coat of asphalt surface for the streets, and street lights are secured by a$83,500 Letter of Credit and a Public Improvement Agreement. The sidewalks -and street trees are secured through an Agreement for Sidewalk and Street Trees.These improvements will be installed as homes are constructed on the adjacent lots. As a result of this review, staff has determined that the Final Plat for Somerset Subdivision Twelfth Addition should be approved. ALTERNATIVES: 1. The City Council can approve the Resolution of Partial Completion of Public Improvements and the Final Plat for Somerset Subdivision Twelfth Addition. 2. The City Council can deny approval of the Resolution of Partial Completion of Public Improvements and the Final Plat for Somerset Subdivision Twelfth Addition. 3. The City Council can refer these items back to staff and the developer for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Resolution of.Partial Completion of Public Improvements and the Final Plat for Somerset Subdivision Twelfth Addition. All subdivision requirements have been fulfilled.
