COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING THE FINAL PLAT FOR PALENSKY
SUBDIVISION, LOCATED SOUTHEAST OF THE INTERSECTION OF 240T" STREET
AND 500T" AVENUE, OUTSIDE THE CITY'S CORPORATE LIMITS, BUT WITHIN THE
TWO-MILE JURISDICTION OF THE CITY.
BACKGROUND:
The property owner is requesting that the Final Plat for Palensky Subdivision be approved.
The proposed subdivision is located outside the corporate limits of the City of Ames, but
within the two-mile jurisdiction area of the City. The property is located southeast of the
intersection of 240th Street(just south of U.S. Highway 30)and 500th Avenue (County Line
Road), including approximately 83.91 acres.
The Final Plat for Palensky Subdivision (see attached)divides the subject property into two
. (2) single-family residential lots, as follows:
• Lot 1: 15.10 acres; and,
• Lot 2: 68.81 acres.
The property is under the zoning jurisdiction of Story County. The zoning designation is:
"A-1" (Agricultural).
On July 23, 2002, the Ames City Council passed Resolution No. 02-408, approving a
request for waiver of the subdivision regulations for the subject property,with the following
stipulations:
• The property owners of the proposed subdivision must provide the City with an
easement, at no cost,for the extension of public sanitary sewer infrastructure at the
time that the City deems it necessary to construct such infrastructure improvements.
The easement is to be placed on the entire property at this time, and the location is
to be further defined at the time that improvements are to be constructed. This
easement must be signed by the property owners, prior to consideration of the Final
Plat by the City Council.
• The property owners must waive their rights to object to future assessments for
public improvements, including, but not limited to street paving, bicycle paths,
sidewalks, and utility improvements, prior to consideration of the Final Plat by the
City Council.
• The Story County Health Department must approve a plan for wastewater treatment
and disposal, prior to consideration of the Final Plat by the City Council.
• The property owners must sign an agreement that requires the property owners to
pay any and all costs related to disconnection of the rural water facilities when the
land is annexed into the City.
The property owners have met the stipulations, described above.
There are no public street improvements to be installed for this subdivision. All proposed
lots will have access onto 240tt' Street, located along the north boundary of the subdivision.
Staff believes all requirements for the Final Plat approval have been met and recommends
approval of the Final Plat for Palensky Subdivision.
ALTERNATIVES:
1. The City Council can approve the Final Plat for Palensky Subdivision.
2. The City Council can deny approval of the Final Plat for Palensky Subdivision.
3. The City Council can refer the Final Plat back to staff and the property owners for
additional information.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council approve Alternative #1.
This will approve the Final Plat for Palensky Subdivision. All subdivision requirements
have been fulfilled.
