RESOLUTION SETTING DATE OF PUBLIC HEARING ON FIRST READING OF
ORDINANCE VACATING 180' x 16' ALLEY RIGHT-OF-WAY
FOR THE CITY OF AMES
WHEREAS, City of Ames staff was approached by Kent Cooper, representing Forest Park
Properties LLC, requesting the vacation and conveyance of 16' X 180' of public alley right-of-way
(ROW); and,
WHEREAS, Forest Park Properties owns several parcels adjacent to this alley,which is north
of Lincoln Way and runs east from Elm Avenue to a dead end; and,
WHEREAS,Forest Park has frontage on both sides of the alley totaling 300',and Greater Iowa
Credit Union has an annex building to the north side of the alley with 60' of frontage; and,
WHEREAS, Greater Iowa Credit Union has stated that it is are not interested in obtaining the
portion of right-of-way that is adjacent to its building (there is no pedestrian or vehicle access to the
Greater Iowa Credit Union from the alley); and,
WHEREAS,the City of Ames Municipal Electric Services also has an overhead three-phase line
running along the north side of the alley; and,
WHEREAS, if City Council decides to vacate and convey this right-of-way, a Public Utility
Easement will be obtained by September 24,2019,over the entire alley area,and this easement will also
allow Greater Iowa Credit Union access the rear of its parcel for building maintenance.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,that
a date of public hearing set for August 27,2019,for the first reading to approve the vacation of the 180'
X 16' alley right-of-way north of Lincoln Way and east of Elm Avenue is hereby approved.
ADOPTED THIS 23rd day of July, 2019.
