I, Franklin J. Feilmeyer, am an attorney licensed to practice in the State of Iowa, and my principal
place of business is located at 618 Douglas Avenue,P.O. Box 270,Ames,Iowa 50010-0270. In accordance
with section 3 54.11 of the Code of Iowa and for the limited purpose described therein,I have examined the
abstract of title to the Real Property more particularly described in the attached Consent to subdivision plat-
ting and to be known as:
Palensky Subdivision,Story County,Iowa..
IT IS MY PROFESSIONAL OPINION, based on said examination,that:
L The fee simple title to said Real Property is vested in:
Edwin B.Finch and Mary E.Finch,
who are the sole owners and proprietors entitled and required to consent to the subdivision plat-
ting, subject to easements, rights-of-way, restrictive covenants of record and applicable govern-
mental regulations.
2. There are holders of mortgages, liens, or other encumbrances on said Real Property being platted.
as follows:
2.1. The real estate was mortgaged by Edwin B. Finch and Mary E. Finch to Farm Credit
Bank of Omaha to secure an original indebtedness of$63,000.00. The mortgage is dated
27 November 1991, and was filed in the office of the Recorder of Story County,Iowa, on
5 December 1991, and recorded in Book 434 at Page 297.
2.2. The real estate was mortgaged by Edwin B. Finch and Mary E.Finch to Farm Credit Ser-
vices of America, FLCA to secure an original indebtedness of$240,000.00. The mort-
gage is dated 12 March 2002,and was filed in the office of the Recorder of Story County,
Iowa, on 25 March 2002, and recorded as Instrument N°02-04513.
