HomeMy WebLinkAboutA002 - Council Action Form dated September 24, 1985 i ITEM #: DATE: 9/24/85 COUNCIL ACTION FORM SUBJECT: Resolution Reaffirming the Approval of Willow Creek Estates Third Addition BACKGROUND: On October 4 , 1983, the Ames City Council approved the Conceptual Development Plan for Willow Creek Estates Third Addition which is located at the corner of South Dakota Avenue and Mortensen Road. Section 23. 11 of the Municipal Code requires that the Administrative Plat be submitted within one year after approval of the CDP by the City Council . Since the Administrative Plat was not submitted by October 4, 1984, the Conceptual Development Plan must be reaffirmed by the Planning and Zoning Commission and the City Council before the applicants can proceed with the platting process. This property is zoned R-2 (Low-density Residential ). The amended PUD Plan for Willow Creek Estates was approved on October 4, 1983 by the Ames City Council to allow the construction of a place of worship on this site. The landscape plan for this site was approved by the City Council on November 11, 1983. The property owners wish to begin construction of the first phase of the. church development . This will involve the construction of a combination church and recreation building located in the southwest portion of the property. A Building Permit for this construction cannot be issued until the Administrative Plat for Willow Creek Estates Third Addition is approved. Previous approval of this Conceptual Development Plan included the stipulation that a 40-foot, half-width right-of-way be provided along the south boundary of this property. It would be consistent to require this same stipulation in the reaffirmation of this CDP. The plan being submitted is the same plan that was approved on October 4, 1983. The Planning and Zoning Commission met on September 18, 1985 and has recommended that the approval of the Willow Creek Estates Third Addition be reaffirmed. ALTERNATIVES: 1. The City Council can approve the request to reaffirm the CDP for Willow Creek Estates Third Addition with the stipulation that a 40-foot half-width right-of-way be provided along the south boundary of the property. 2. The City Council can deny approval of the request to reaffirm the CDP for / Willow Creek Estates Third Addition. 2 MANAGER 'S RECOMMENDED ACTION: The City Manager recommends that the City Council accept Alternative 1. This will allow the property owners to proceed with the submittal of the Administrative Plat pursuant to Section 23.11 of the Municipal Code in order to obtain a Building Permit.
