RESOLUTION PROPOSING SALE OF RIGHT-OF-WAY ADJACENT TO 635 AGG
AVENUE IN AMES, IOWA; SETTING DATE, TIME,AND PLACE OF PUBLIC HEARING
THEREON AND DIRECTING PUBLICATION OF NOTICE
FOR THE CITY OF AMES,IOWA
WHEREAS,the owners of 635 Agg Avenue, Steven and Sarah Walter,contacted City of Ames
staff regarding the vacation and conveyance of 100'X T of public right-of-way(ROW)adj acent to their
property; and,
WHEREAS,a letter sent by Mr.Walters states their reason for the request is to construct a new
garage addition; and,
WHEREAS,the valuation according to the City's standard formula is$3,165.75,which is based
on adjacent land values minus 10% for quit claim deed and 15% for maintaining an easement; and,
WHEREAS,the other adj acent property owners at 2114 Country Club Blvd,Melissa and Patrick
Rowan,have indicated in a signed letter that they do not wish to purchase any portion of this ROW area,
if vacated; and,
WHEREAS, Utility companies have been contacted with City of Ames Electric and Century
Link responding that they have existing infrastructure in this ROW area; therefor, as a condition of
vacation and conveyance, a public utility easement will be established over the entire vacated area as
indicated on the vacation and easement plats.
NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that
a date of public hearing will be set for July 9, 2019, for the conveyance of the vacated public ROW to
the owners of 635 Agg Avenue (Steven and Sarah Walter) for$3,165.75 as determined by the City's
standard formula, is hereby approved.
