THE-UNDERSIGNED, Phil Coy and Sons, a partnership composed of
Jack Coy and Richard Coy; Jack Coy and Elizabeth E. Coy, Husband and lkif
Richard Coy and Gretchen Coy, Husband and Wife, and Richard K. Bliss and
Patricia L. Bliss, Husband and Wife; in consideration of the sum of One
Dollar and other considerations, receipt of which is hereby acknowledged,
do grant to the City of Ames, Iowa, a municipal corporation, its successors
and assigns, the perpetual right to construct, reconstruct, maintain and use
electric lines, consisting of poles, wires, cables, conduits, fixtures,
anchors and other similar equipment, including the right to trim or re3-nove
trees within such area where necessary to secure a clearance of 4 feet from
the wires or poles, together with the right to extend to telephone, telegraph,
electric or power companies, or a company, the right to use separately or
Jointly with the City of Ames the areas included in this easement for the
purposes above enumerated, over, upon, across or under the following
described real estate, situated in the county of Story, State of Iowa, to-wit:
The East 5 feet of Lots 4, 9, 15, 1,6, 17, 1.8, 19, 20, 21 and 22;
The West 5 feet of Lots 1, 2, 3, 6, 7, 10, 11, 12, 13 and i4;
The North 5 feet of Lots 4, 5, and 6;
The South 5 feet of Lots 7, 8, 9, 14 and 15;
The South 4 feet of Lo t s 2, 1.0, 17 and 20;
The North 4 feet of Lots 3, 11, 16 and 19;
Also, a tract 5 feet in width extending 25 feet East from the northeas
corner of Lot 4 and centered on the North line of Lot 4 extended;
Also, a tract 5 feet in width extending 25 feet East from the southeas ;
corner of Lot 9 and centered on the south line of Lot 9 extended;
All of said lots being located in Allenview Third Addition to Ames,
Iowa;
and do further grant to the City of Anies, Iowa., a' municipal corporation, its
successors and assigns, the perpetual right to construct, reconstruct, main-
tain and I I use sanitary sewer upon and underground that real estate described
as follows:
The North 2. 3 feet of Lot 19;
The Sou'd-i 7. 7 feet of Lot 20;
All of said lots being in Allenview Third Addition to Ames, Iowa.
The foregoing rights are granted upon the express condition that the
City of Ames will assume responsibility for all damage to the above des-
cribed property caused by the city's failure to use due care in the exercise
of its granted right.
