HomeMy WebLinkAboutA005 - Agreement dated February 2, 1965 i A G RE E M E N T This agreement made and entered into this ,-I- day of 1965, by and between Green Meadows Co. , hereinafter referred to as First Party and the City of Ames, Iowa, hereinafter referred to as Second Party, WITNESSETH: WHEREAS, the First Party is in the process of platting a subdivision of Ames, Iowa, to be known as Crestwood Sixth Addition to Ames, Iowa, and located within the territorial boundaries of the City of Ames, Iowa; and, 'WHEREAS, The First Party is required to complete construc- tion of sidewalks, including grading and seedirg of parking, and to pay reasonable engineering and inspection fees therefor, all as a part of the platting procedures and in compliance with the platting ordinances of the City of Ames, Iowa; THEREFORE, in consideration of the premises, it is hereby' AGREED that First Party shall deposit with the Second Party a suret bond or a certified check in the amount of c� conditional upon the completion of said improvements. It is further agreed that said improvements must be com- pleted within two years from and after the date of final approval of Crestwood Sixth Addition to Ames, Iowa, and the said improvement shall be constructed to meet the approval of Second Party acting through the City Engineer' s Office. It is further agreed that Second Party reserves the right to complete the said improvements, in the event First Party fails t do so, as herein agreed, and to cover the costs thereof with the certified check or the surety bond, as the case may be. It is further agreed that upon the satisfactory completion of the-said improvements, including the paying of a reasonable engineering and inspection fee therefor, the bond shall be released and the bondsman exonerated, or the certified check shall be returned to the First Party, as the case may be.
