ACCESS EASEMENT
KNOW ALL PERSONS BY THIS INSTRUMENT that Mark Harmison and Elizabeth
Harmison, owners of the real estate described as
A replat of a parcel of land in the Northwest Quarter of the Northwest Quarter of Section 18,Township 83
North,Range 24 West of the 5th P.M., Story County,Iowa previously surveyed by R.J.Lubsen in April,
1972 and filed in the office of the Story County Recorder in Book 3,Page 114 and being more particularly
described as follows: Commencing at the Southwest Corner of the Northwest Quarter of the Northwest
Quarter of said Section 18;thence N00100'00"E,90.80 feet along the west line of said Section 18 to the
point of beginning,thence continuing N00°00'00"E,304.80 feet;thence S89°12'28"E,842.05 feet;thence
S00°33'47"W,286.82 feet;thence S89°33'59"W,839.18 feet to the point of beginning,containing 5.71
acres which includes 0.23 acres of existing public right of way.
which is being subdivided into two lots(Lot 1 and Lot 2), know collectively as the
Windy 500 Subdivision, Story County, Iowa, grant an easement for access to 500a'
Avenue from Lot 2, going through Lot 1 in such a manner as exists today(a gravel
driveway), or as may be mutually agreed upon in the future by all owners of both lots at
that time.
Any costs associated with this access driveway will be shared equally by the owners of
both lots for those portions of the driveway that are used in common. Each owner
assumes full liability for their own use of the driveway and of any use made by others
coming and going from their lots.
