HomeMy WebLinkAboutA002 - Council Action Form dated October 22, 2002 ITEM # a® DATE 10/22/02 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING THE FINAL PLAT FOR DANIELS SUBDIVISION, FIRST ADDITION. BACKGROUND: The property owners are requesting that the Final Plat for Daniels Subdivision, First Addition be approved. The property in question includes one existing lot on the east side of South Duff Avenue, at the intersection of Chestnut Street. The entire area of the Daniels .Subdivision, First Addition includes 7.58 acres. The property is currently zoned "HOC' (Highway-Oriented Commercial). Best Buy Stores, L.P. has purchased the lot and is proposing to construct a Best Buy Store on the southern half of the site:=The=applicants-are proposing-to subdivide the-7.58-acre site--into-two-lots=(see-attached -drawing)-,drawing),-Lot-1_will-contain the proposed Best Buy Store-that.is-currently under construction._Lot 2 will be_sold and will contain_a-.proposed Borders Book Store- Site plans have been reviewed and approved for both of the stores, subject to approval of this Final Plat. The two stores will actually be constructed with a common wall along the lot line between Lots 1 and 2. On August 28, 2002, the Zoning Board of Adjustment approved a setback variance to allow the construction of the two buildings with the common wall across the proposed property line. With the setback variance, the proposed lots meet the Zoning Ordinance and Subdivision requirements. Direct vehicular access to Lot 2 will be prohibited from South Duff Avenue. Access to both lots will be from one access drive, which will line-up with Chestnut Street and be located within Lot 1. Cross-access easements are required to allow vehicular access to Lot 2. The applicant has submitted the required cross-access easement documents. There are no public improvements to be installed with this Final Plat except sidewalks.The applicant has agreed to install the sidewalks as required along the east side of Duff Avenue as part of the site plan review process for the Best Buy and Borders Book Stores. As a result of this review, staff has determined that the Final Plat for Daniels Subdivision, First Addition should be approved. ALTERNATIVES: 1. The City Council can approve the Final Plat for Daniels Subdivision, First Addition. 2. The City Council can approve the Final Plat for Daniels Subdivision, First Addition, with modifications. 3. The City Council can deny approval of the Final Plat for Daniels Subdivision, First Addition. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Final Plat for Daniels Subdivision, First Addition.
