HomeMy WebLinkAboutA022 - Council Action Form dated September 10, 2002 ITEM # 34 4b DATE 09/10/02 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT BETWEEN AMES LAND COMPANY, L.L.C. AND THE CITY OF AMES AND A RESOLUTION APPROVING THE FINAL PLAT FOR BLOOMINGTON HEIGHTS WEST PLAT 1. BACKGROUND: Development Agreement. The City Council is being asked to approve a Development Agreement for Bloomington Heights West Plat 1. This subdivision includes the construction of improvements to the infrastructure of the City that are on and off the site that is proposed to be subdivided. It is customary that a Development Agreement be prepared that documents the responsibility of both the City and the Developer relative to these types of infrastructure improvements. Further, when the Planning and Zoning Commission took action to recommend that the Preliminary Plat for Bloomington Heights West be approved, they included as a stipulation to that recommendation that a Development Agreement be prepared that addresses these issues. The issues with respect to off-site improvements, which are included in the proposed Development Agreement are described as follows: • Construction of bike path improvements, as specified by the City, along the north side of Harrison Road; • Construction of two CyRide bus stop pads, as specified by the City, on Harrison Road; • The Developer shall pay to the City, prior to approval of any final plat of the subdivision with respect to the site, the sum of $12,892.00 to reimburse the City for the cost of increasing the total wet volume of treatment facility SP-42, on City property for secondary treatment of the quality of the storm water runoff from the site. Note: The City of Ames has received a check for $12,892.00 to cover the developer's portion of the cost of constructing treatment facility SP-42. With respect to the on-site improvements for the proposed Bloomington Heights West subdivision, all of the proposed improvements that are of the minimum size required by the City will be the responsibility of the Developer as provided for in the subdivision regulations of the City. e Final Plat of Bloomington Heights West Plat 1. The proposed Final Plat involves the creation of 12 platted lots for single-family detached residential development, 26 platted lots for bi-attached single-family dwellings, three lettered lots (Lots `A', `B', and `C'), and three outlots (Outlots `A', `X', and `Z') for future residential development. The entire area of the Bloomington Heights West Subdivision Plat 1 includes 46.58 acres. The density of the development, for the proposed 12 single-family detached lots, is 4.33 dwelling units per net acre, and the lots range in size from 7,875 sq. ft. to 12,394 sq. ft. This area of this Final Plat is zoned as "RL" (Residential Low Density) district. The density of the development, for the proposed 26 platted lots for bi-attached single-family dwellings, is 13.98 dwelling units per net acre, and the lots range in size from 2,904 square feet to 3,622 square feet. This area of the Final Plat is zoned as PRD-RM (Planned Residence Development — Residential Medium Density). All lots meet the minimum requirements of the Zoning Ordinance. The developers have installed none of the required public improvements for this subdivision, which includes all underground utilities, (i.e. water, storm sewer, and sanitary sewer infrastructure improvements), streets, sidewalks, bike path, and street lights. The utilities, streets, and street lights, are secured by a $183,964.80 Performance Bond and a Public Improvement Agreement. The sidewalks, bike path, and street trees are secured through an Agreement for Sidewalk and/or Bike Path and Street Trees. These improvements will be installed as homes are constructed on the adjacent lots. As a result of this review, staff has determined that the Final Plat for Bloomington Heights West Plat 1 should be approved. 2 ALTERNATIVES: 1. The City Council can approve the Development Agreement for Bloomington Heights West and the Final Plat for Bloomington Heights West Plat 1. 2. The City Council can approve the Development Agreement for Bloomington Heights West and the Final Plat for Bloomington Heights West Plat 1, with modifications. 3. The City Council can deny approval of the Development Agreement for Bloomington Heights West and the Final Plat for Bloomington Heights West Plat 1 . MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative #1. This will approve the Development Agreement for Bloomington Heights West and the Final Plat for Bloomington Heights West Plat 1. All subdivision requirements have been fulfilled.
