HomeMy WebLinkAboutA002 - Council Action Form dated August 27, 2002 a. • ITEM # DATE 08/27/02 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING THE PARTIAL COMPLETION OF PUBLIC IMPROVEMENTS IN DAUNTLESS SUBDIVISION SEVENTH ADDITION AND A RESOLUTION APPROVING THE FINAL PLAT FOR DAUNTLESS SUBDIVISION SEVENTH ADDITION. BACKGROUND: The applicant is requesting approval of the Final Plat for Dauntless Subdivision Seventh Addition. The subject site is located south of Mortenson Road, west of South Dakota Avenue, and north of U.S. Highway 30 and includes approximately 28 acres. The proposed Final Plat is a replat of Lots 2 and 3 in the Dauntless Subdivision Fifth Addition and involves the creation of two commercial lots (Lots 1 and 2)and one lot(Lot A) to be dedicated as right-of-wayforthe extension of Dickinson Avenue.The purposeforthe replat is to dedicate the right-of-way for the extension of Dickinson Avenue.At the time that the Final Plat for the Fifth Addition was approved by the City Council (April 10, 2001), the developer was proposing to extend a private street into the site along the alignment of Dickinson Avenue,within a 66-foot wide easement.At this time,the developer is proposing to dedicate the right-of-way for the extension of Dickinson Avenue into the site. Therefore, a new Final Plat is required to allow for the dedication of the right-of-way and revisions to the boundaries of the two adjacent lots. The property is zoned "CCN" (Community Commercial Node). Lot 1 will have vehicular access from the extension of Dickinson Avenue and will also share an access point on Mortenson Road with Lot 1 of Dauntless Subdivision Fifth Addition to the east. Lot 2 will have one vehicular access from Mortenson Road at Poe Avenue and will also have vehicular access from the extension of Dickinson Avenue. Lots 1 and 2 are 7.3757 and 19.6220 acres in size respectively.All lots meet the requirements of the Zoning Ordinance. The developers have not completed the installation of all required publ,ic improvements for this subdivision. Public improvements that have been completed include the installation of water, sanitary sewer and storm sewer utilities, curb and gutter, a.nd street surfacing except for the top coat. Remaining public improvements to be completed include the final topcoat of asphalt paving for the streets and the installation of street lights and sidewalks/bike path. The street lights and final top coat of street surfacing are secured by a$14,250.00 Letter of Credit and an Improvement Agreement. The sidewalk and bike path requirements are secured with an "Agreement for Sidewalk/Bicycle Path", which requires the Owners to complete those improvements prior to the issuance of an "Occupancy Permit". As a result of this review, staff has determined that the Final Plat for Dauntless Subdivision Seventh Addition should be approved. l ALTERNATIVES: 1. The City Council can approve the Resolution of Partial Completion of Public Improvements and the Final Plat for Dauntless Subdivision Seventh Addition. 2. The City Council can deny the Resolution of Partial Completion of Public Improvements and the Final Plat for Dauntless Subdivision Seventh Addition. 3. The City Council can refer these items back to staff and the developer for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative#1. This will approve the Final Plat for Dauntless Subdivision Seventh Addition. All subdivision requirements have been fulfilled.
