Home My WebLink AboutA001 - Resolution No. 02-465 adopted August 27, 2002 CITY OF AMES, IOWA RESOLUTION NO. 02-465 Approving final plat of Seventh Addition,Dauntless Subdivision,Ames, Iowa and accepting the dedication of certain land for street purposes and utility easement BE IT RESOLVED by the City Council of Ames, Iowa: 1. The City Council has authority, as described in article III, section 38A of the Constitution of the State of Iowa and in chapters 354 and 355 of the Code of Iowa(2002)and under the ordinances of the City of Ames, to review and approve subdivision plats of lands lying within the corporate lim- its of the city and within two miles thereof. 2. Terra Firma, L.P., has executed a Consent to Platting for a subdivision to be known as Seventh Addition, Dauntless Subdivision,Ames, Iowa and has requested that the city review and approve the subdivision plat. 3. The City Council finds that said subdivision plat complies with all requirements of chapters 354 and 355 of the Code of Iowa and the platting ordinance of the City of Ames. 4. The City Council accepts and approves the subdivision plat to be known as: Seventh Addition,Dauntless Subdivision,Ames, Iowa, a replat of certain real property more particularly described as: Lots 2 and 3,Fifth Addition, Dauntless Subdivision,Ames, Iowa. 5. The City Council hereby accepts the lands designated on said plat for street right-of-way and for easements and further described as: Lot A, Seventh Addition, Dauntless Subdivision, Ames, Iowa, also described as Dickin- son Avenue. 6. The easement reserved to the City of Ames for public utilities over the westerly 66 feet of Lot 2, Fifth Addition, Dauntless Subdivision, Ames, Iowa,created by the instrument filed 24 April 2001 and recorded as Instrument Ns 01-04737, being merged by the dedication and acceptance herein of Lot A., Seventh Addition, Dauntless Subdivision, Ames, Iowa, is hereby released and extin- guished. 7. The easement for access reserved over the westerly 66 feet of Lot 2, Fifth Addition, Dauntless Subdivision,Ames, Iowa, created by the instrument file 24 April 2001 and recorded as Instrument Ns 01-04739,by virtue of the dedication and acceptance herein of Lot A, Seventh Addition, Daunt- less Subdivision,Ames, Iowa, as a public right-of-way, in acknowledged to be released and termi- nated in accordance with paragraph 4 thereof. 8. The Clerk is authorized and directed to certify and affix to said plat a true copy of this resolution in accordance with sections 354.8 and 354 11 of the Code of Iowa. 9. The City Council finds this resolution appropriate and necessary to protect, preserve, and improve the rights,privileges, property, peace, safety,health,welfare,comfort, and convenience of the City of Ames and its citizens, all as provided for in and permitted by section 364.1 of the Code of Iowa (2002). 10. All other resolutions or parts of resolutions in conflict with this resolution are hereby repealed. If any part of this resolution is adjudged invalid or unconstitutional, such adjudication shall not af- fect the validity of the resolution or action of the City Council as a whole or any part thereof not adjudged invalid or unconstitutional. This resolution shall be in full force and effect from and af- ter the date of its approval as provided by law.
