HomeMy WebLinkAboutA010 - Attorney's Opinion dated August 19, 2002 ATTORNEY'S OPINION I,Deborah S.Krauth,hereby state that I am an Attorney at Law,duly admitted to the practice of law in the State of Iowa,and a member of the firm of Nyemaster,Goode,Voigts,West,Hansell& O'Brien, with offices at 1416 Buckeye, Ste. 200, Ames, Story County, Iowa. I further state that I have examined the Abstract of Title to the following-described real estate, to-wit: A tract of land being a replat of Outlot X of Northridge Heights Subdivision, Third Addition, City of Ames, Story County, Iowa, described as follows: Beginning at the Southeast Corner of said Outlot X; thence S89°50'58"W, 366.97 feet along the Northerly right-of-way line of Bloomington Road to the Southeast Corner of Northridge Heights Subdivision,Second Addition,said City of Ames; thence N00°09'05"W, 627.00 feet along the Easterly line of said Second Addition to the Northeast Corner thereof; thence S89045'57"W, 220.55 feet along the Northerly line of said Second Addition;thence N82°09'32"W,675.00 feet along said Northerly line to the Northwest Corner of said Second Addition, a point on the Easterly line of Northridge Heights Subdivision,First Addition,said City of Ames; thence N00°07'32"W, 35.33 feet along the Easterly line of said First Addition to the Northeast Corner thereof; thence continuing N00°07'32"W, 199.42 feet along the Easterly line of Lots 25 and 24 of said Third Addition to the Northeast Corner of said Lot 24;thence N04°54'21"W,95.75 feet along the Easterly line of Lot 23 of said Third Addition to the Northeast Corner thereof; thence S85024'10"W,44.35 feet along the Northerly line of said Lot 23 to a point on the Westerly line of said Outlot; thence N00°27'49"W, 211.80 feet along said Westerly line to the Northwest Corner of said Outlot;thence N89°44'39"E, 1307.33 feet along the Northerly line of said Outlot to the Northeast Corner thereof; thence S00°14'04"E, 1261.46 feet along the Easterly line of said Outlot to the point of beginning; containing 23.06 acres subject to easements of record. from the root of the title thereof, down to and including the day of V(+%A,CA.v,c71- , 2002, last certified by Abstract & Title Services of Story County(Iowa Title Guaranty Division Member #8650). The real estate has now been subdivided and is now p�e S known as NORTHRIDGE HEIGHTS SUBDIVISION FOURTH ADDITION, STORY COUNTY, IOWA. Based upon information within said Abstract of Title, it is my opinion that the fee simple title to said real estate is in Uthe Development Company,L.L.C. The real estate is free from encumbrances,but is subject to easements and restrictions of record and to zoning ordinances of the City of Ames, Iowa. Dated this ' T day of t, 2002.
