Re: The Pointe - Conservation Easement

Dear Mayor & Council:
On the behalf of Hubbell Realty we have reviewed the conservation easement
for the Pointe Subdivision and request the following changes:
• Item 5 - "Burial sites will not be disturbed in any way". A Phase 3
archeological investigation did not find any burial sites. State law and
federal law still provide protection in the event a site is discovered.
• City Staff has also requested that Lots 6 through 10 and lots 28 and 29
not be allowed to have deck or gazebo construction within the
conservation easement. While this is not an issue for lots 6 through 10
Hubbell would request that a gazebo be allowed in Lot 29 and a deck on
Lot 28. A large portion of Lot 29 is relatively flat and open. Lot 28 has
the smallest buildable lot within the conservation easement area.
