Re: Plat of South Dayton Development
Dear Ms. Voss:
In confirmation of my telephone conversation with you, I would like to be heard on behalf of the
adjoining land owner to the proposed South Dayton Development Plat in the matter to be submitted
to the Council on May 22, 2001.
On May 2, 2001, the Planning and Zoning Commission approved the preliminary plat of South
Dayton Development over the objections of the adjoining land owner, Hickory Park, Inc., whose
land is burdened with a street which shows on the survey as Southeast 16"Street Swing,also known
as Isaac Newton Drive. Its purpose is apparently to serve certain lots within the subdivision.
Although the Planning and Zoning Commission was very concerned about the road upon my client's
property,the spur was not eliminated when the final plat was approved. Although we do not object
to the platting of the area, we do object to the burden of the street which will show of record as
infringing upon our property.
Although my client does not intend to immediately improve his property,that certainly would be his
plan in the future and the spur road may be a hindrance to the future plans.
Therefore, I request to be heard on this matter when it is submitted to the City Council for final
approval. It is my understanding it is set on the agenda for the Tuesday,May 22,2001,meeting and
the identity of the plat has been changed, but I am not aware of the new name identification.
