HomeMy WebLinkAboutA001 - Resolution No. 02-328 adopted June 11, 2002 CITY OF AMES,IOWA RESOLUTION NO. 02-328 Approving final plat of Second Addition, Terra Firma Subdivision,Ames, Iowa BE IT RESOLVED by the City Council of Ames, Iowa: 1. The City Council has authority, as described in article III, section 38A of the Constitution of the State of Iowa and in chapters 354 and 355 of the Code of Iowa(2002) and under the ordinances of the City of Ames, to review and approve subdivision plats of lands lying within the corporate lim- its of the city and within two miles thereof. 2. Terra Firma, L.P., an Iowa limited partnership, has executed a Consent to Platting for a subdivi- sion to be known as Second Addition, Terra Firma Subdivision, Ames, Iowa and has requested that the city review and approve the subdivision plat. 3. The City Council finds that said subdivision plat complies with all requirements of chapters 354 and 355 of the Code of Iowa and the platting ordinance of the City of Ames. 4. The City Council accepts and approves the subdivision plat to be known as: Second Addition,Terra Firma Subdivision,Ames,Iowa, which is a replat of certain real property more particularly described as: Parcel"T" in Lot 1,Parker's Addition, in the City of Ames, Story County,Iowa, as shown on the "Plat of Survey" filed in the office of the Recorder of Story County, Iowa, on December 20, 2001, and recorded as Instrument N° 01-18151 on Slide 115 at Page 4, and more particularly described as: Beginning at the Southeast corner of Lot 1, Parker's Addition, in the City of Ames, Story County,Iowa;thence North 89'46' 08"West, 174.8I feet along the south line of said Lot 1;thence Northeasterly, along the northwesterly line of the Fort Dodge, Des Moines & Southern abandoned Railway and along a 490-foot radius curve, concave southeasterly, an arc distance of 237.26 feet (the long chord bears North 34'00' 17"East, 234.95 feet); thence South 89'46' 08" East, 43.41 feet along the north line of the South 195.3 feet of Lot 1; thence South 00, 00' 00" West, 195.30 feet along the west line of Stanton Avenue, to the Point of Beginning. 5. The Clerk is authorized and directed to certify and affix to said plat a true copy of this resolution in accordance with sections 354.8 and 3 54.11 of the Code of Iowa. 6. The City Council finds this resolution appropriate and necessary to protect, preserve, and improve the rights,privileges,property,peace,safety,health,welfare, comfort, and convenience of the City of Ames and its citizens, all as provided for in and permitted by section 364.1 of the Code of Iowa (2002). 7. All other resolutions or parts of resolutions in conflict with this resolution are hereby repealed. If any part of this resolution is adjudged invalid or unconstitutional, such adjudication shall not af- fect the validity of the resolution or action of the City Council as a whole or any part thereof not adjudged invalid or unconstitutional. This resolution shall be in full force and effect from and af- ter the date of its approval as provided by law.
