I further state that I have examined the Abstract of Title in four parts to the following-described real estate,to-wit: Parcel G in the Southeast Quarter(SE%)of the Southwest Quarter(SW%)of Section Six(6),Township Eighty-three(83)North,Range Twenty-three.(23)West of the 5' P.M., Story County, Iowa and Lots One (1), Two (2) and Three (3) of Thies' Subdivision of a part of Lot 1, Spencer's First Industrial Addition to the City of Ames, Iowa, from the root of title thereof,down to and including the 21 S'day of March,2002,at 2:08 o'clock p.m. for Lot Three (3) and the 24" day of April, 2002 at 8:00'o'clock a.m. for Lot One (1), both last certified by Abstract and Title Services of Story County,Ames,Iowa(Iowa Title Guaranty Division Member #8650) and to the 261 day of March, 2002 at 8:00 o'clock a.m. for Lot Two (2), last certified by Batman Sayers Abstract Company, Nevada, Iowa (Iowa Title Guaranty Division Member#8212). Based upon information within said Abstracts of Title and other instruments of which said attorney has personal knowledge but which were not filed of record as of the most recent Pat5 e- 3 2 continuation of said Abstract,it is my opinion that legal title to the real estate is in API Properties #165,L.L.C., a Nevada Limited Liability Company, (an undivided 45%interest); Carlsen-Bell Ave., L.L.C., a Delaware Limited Liability Company, (an undivided 45% interest); and, D. Roberts Investments, L.L.C., a Delaware Limited Liability Company, (an undivided 10% interest), subject to the following There are no liens against the subject real estate. The property is further subject to easements and restrictions of record and to zoning ordinances of the City of Ames, Iowa. Dated this 13"day of May, 2002.
