EASEMENT AGREEMENT
This Agreement is made this 2 i day of w ht ,2007,between SOMERSET
TOWN CENTER SOUTH,Grantor,and CITY OF AMES,STORY COUNTY,IOWA,Grantee.
WHEREAS, Somerset Town Center South is owner of certain real property in Ames, Story
County, Iowa, legally described as:
The West 25.00 feet of Outlot WW in Somerset Subdivision Eleventh
Addition, City of Ames, Story County, Iowa;
C'Easement Area"), and
WHEREAS,in order to meet City regulations,it is necessary that an easement for ingress and
egress be put in place over the Easement Area;
NOW, TIEREFORE, Somerset Town Center South grants the following easement to the
City of Ames, Iowa and its successors and assigns:
1. Easement. Somerset Town Center South hereby grants an easement for ingress and
egress over the Easement Area to the City of Ames, Iowa, and its successors and assigns.
2. Easement Running with Land. This easement and all agreements contained herein
shall be easements and covenants running with the land and shall inure to the benefit and be binding
on the parties hereto and their respective heirs, successors and assigns,including without limitation,
all subsequent owners of the above described property and all persons claiming thereunder.
In witness whereof, the parties sign this Agreement on the date and year first above written.
