HomeMy WebLinkAbout~Master - Approving Mutual Release of Developmenet Agreement for Property at 1801 20th Street and 2008 24th Street DO NOT WRITE IN THE SPACE ABOVE THIS LINE;RESERVED FOR RECORDER Prepared by: Mark Lambert,Interim City Attorney,City of Ames,515 Clark Ave.,Ames,IA 50010;515-239-5146 Return to: Ames City Clerk,P.O.Box 811,Ames,IA 50010 RESOLUTION NO. 18-485 RESOLUTION APPROVING MUTUAL RELEASE OF DEVELOPMENT AGREEMENT FOR PROPERTY AT 1801 20TH STREET AND 2008 24TH STREET FOR THE CITY OF AMES,IOWA WHEREAS, the City of Ames and Northcrest, Inc. entered into Development Agreement on January 7, 2013; and, WHEREAS, the Development Agreement specified that use shall be restricted to either Group Living or Community Facilities; and, WHEREAS, the Development Agreement states that Developer shall restrict height of structures to a maximum building height that does not exceed the existing building height of the current Northcrest, Inc., property, or fifty(50) feet or four (4) stories, whichever is lower, for all buildings on this site; and, WHEREAS, City staff has reviewed the terms of the Agreement and find that they have been satisfied in regards to this property; and, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that satisfaction of the terms of the 2013 Development Agreement, as they apply to the property at 1801 201h Street and 2008 241h Street, is hereby accepted, and the property is released from the terms of the Agreement.
