Title Opinion February 27, 2002 +� I Page 2 EXCEPTIONS Entry 31 of the Abstract shows a mortgage against the property in favor of First National Bank, Ames, Iowa, dated November 2, 2001 and filed in the office of the Story County Recorder as Instrument No. 0 1-15461 on November 8, 2001. Entry 30 of the Abstract shows a Phase 2, Suncrest Subdivision Covenant For Payments Of Costs Of Improvements against the property dated October 23, 2001 and filed in the office of the Story County Recorder on October 30, 2001, which provides that the Developer or Purchaser shall pay the City of Ames, Iowa, the pro-rata share of each lot, at the sale of the lot or before the issuance of a building permit for improvements, including engineering, inspection, and financing costs for paving one lane of Cedar Lane and constructing a sidewalk along the east right-of-way line of Cedar Lane. Entry 29 of the Abstract shows an Agreement For Sidewalk And Street Trees against the property dated October 23, 2001 and filed in the office of the Story County 'Recorder as Instrument No. 01-14850 on October 30, 2001, which requires the Owner to construct a sidewalk and plant trees before a building permit or occupancy permit will be issued. Entry 28 of the Abstract shows an Easement Grant to the City of Ames, Iowa, dated September 27, 2001 and filed in the office of the Story County Recorder as Instrument No. 01-14849 on October 30, 2001, for a General Utility Easement over and across the North 10 feet and the South 5 feet of the property and for Surface Drainage and Storm Water Detention Easement over and across the South 10 feet of the property. Entry 32 of the Abstract shows that pursuant to Ordinance No. 3557 passed April 25, 2000 and filed in the office of the Story County Recorder as Instrument No. 00-04606 on TMay 3, 2000, the property is zoned "RL," Residential Low Density Zone. Entry 34 of the Abstract shows that in reference to Real Estate taxes for Fiscal Year 2000-01, that the First and Second Installments have been paid. My understanding of this arrant-;ernent is that this amount will be paid to the City when a lot in the Suncrest second addition is sold. The payment enclosed is for lot 44, 2323 Suncrest Drive that was sold to Hadaway Construction on February 11, 2002. The City should have received a check from Friedrich Iowa Realty for lot 425, 2320 Sundown Drive that was sold to Tasteful Homes, Inc. on March 11, 2002.
