Re: Mosque Plat Argument
Dear Mayor Curtis and Council Members:
The argument that the plat cannot be approved because the land platted does not meet the technical
definition of"tract" is not applicable to a voluntary plat.
The application of Darul Argum is for approval of a proposed"Subdivision Plat". The definition of
"Subdivision Plat" is at §354.1(17)which states:
"`Subdivision Plat' means the geographical representation of the subdivision of land,
prepared by a registered land surveyor, having a number or letter designation for each
lot within the plat and a succinct name or title that is unique for the county where the
land is located."
The term"tract" is not used in the definition of "subdivision plat".
The process for approval of a"subdivision plat" is stated in Section 354.8. The term"tract" is not used
in that section.
The term"tract" is used in section 354.6, which prescribes when a"subdivision plat shall be made" ,
i.e., when a plat is mandatory. It may well be that a plat is not mandatory for divisions of a land area
that is less than a quarter-quarter section. However, that has no bearing on a voluntary application for
a"plat of subdivision".
