HomeMy WebLinkAbout~Master - Public Hearing for Vacation of Easements at 530 SE 16th Street and 900 SE 16th Street DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Ames City Clerk,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 18-254 RESOLUTION SETTING DATE OF PUBLIC HEARING FOR VACATION OF EASEMENTS AT 530 SE 16TH STREET AND 900 SE 16TH STREET FOR THE CITY OF AMES,IOWA WHEREAS, a Site Plan for the new Menards store at 530 and 900 SE 16`l' Street is currently under review by City of Ames staff; and, WHEREAS, as part of the review process, it was determined that two existing Electric Easements and one existing Sanitary Sewer easement need to be vacated; and, WHEREAS,the Electric Easements can be vacated because they will no longer be of use, and the Sanitary Sewer Easement may be vacated because the location does not match the actual location of the sanitary sewer mains; and, WHEREAS, all three Easements were granted to the City of Ames, and only the City will be impacted by their vacation; and, WHEREAS, a new Sanitary Sewer Easement will be secured in the correct location as part of the Final Plat process; and, WHEREAS,pursuant to Iowa Code section 364.7,it is necessary to provide Notice and public hearing regarding the proposal of the City to dispose of its interest in this real property; and, WHEREAS,following Legal Notice and public hearing,the City will determine if this proposal is appropriate. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES, IOWA, THAT: 1. Pursuant to Iowa Code Section 364.7, publication of Notice regarding the proposed vacation of an easement and establishing a public hearing date regarding the proposal is required. 2. The public hearing regarding the proposal to consider vacation of the City's interest in two Electric Easements and one Sanitary Sewer Easement at 530 SE 16t1i Street and 900 SE 16t' Street shall be held on May 22, 2018, at 6:00 p.m. 3. The City Clerk is hereby directed to provide Notice of the public hearing as required by Iowa Code section 362.3. ADOPTED THIS 81h day of May, 2018. �, r Diane R.
