I have examined the Abstract of Title for the property

TITLE
I found title to the above described real estate (herein—
after called the property) to be in E. Kent Cooper and Joan E.
rs Cooper as Tenants in Common, by virtue of two (2) Warranty Deeds
`i dated June 1, 1993, and recorded in the Office of the Story .
County Recorder in Book. 520 at Page 128 and Page 130 on June 14,
1993, and by virtue of a Deed from the Chicago North Western
Transportation Company dated May 12, 1993, and recorded in Book
514 Page 129 in the Office of the Story County Recorder on
` May 24, 1993.
SPECIAL NOTATION
w It is noted that, in reference to the property conveyed by
i� the Chicago and Northwestern Rail Way Company to E. Kent Cooper
and Joan E. Cooper, the chain of title is established.as follows:
Entries 1B and 1C of the Abstract show the conveyance of a
.;> strip of ground One Hundred (100) feet wide on October 20,
1877 to the Des Moines and Minneapolis Railroad Company
77 which then conveyed all its property to the Chicago and 1 Northwestern Rail Way Company on October 24, 1884.
Entry 2 of the Abstract shows the conveyance of a strip of
ground Fifty (50) feet wide, •south of- the aforesaid One
,i. Hundred (100) feet strip on March 25, 1891 to the Ames
Street Railway Company. Entry 9 of the Abstract shows that
} the Fort Dodge, Des Moines and Southern Railroad Company was
the successor of the Ames Street Railway Company. Entry 1D
of the Abstract shows that the Fort Dodge, Des Moines and
Southern Railroad Company granted a Quit Claim Deed of the
aforesaid strip of Fifty (50) feet to the Chicago and
( Northwestern Rail Way Company on July 10, 1917,

The property conveyed to E. Kent Cooper and Joan E. Cooper
by the Chicago and Northwestern Rail Way Company (Entry 28B
of the Abstract) is within the aforesaid total strip of One
Hundred Fifty (150) feet. Also, a sufficient chain of title
to the property conveyed to E. Kent Cooper and Joan E.
Cooper by the Chicago and Northwestern Rail Way Company in
Entry 28B of the Abstract is further confirmed by the 40
Year Marketable Title Act, g614.29-..39, Code -of Iowa, since
r the Chicago and Northwestern Rail Way Company has had an
unbroken chain of title for more than forty (40) years.
