ATTORNEY'S OPINION
I,Deborah S.Krauth,hereby state that I am an Attorney at Law,duly admitted to the practice
of law in the State of Iowa,and a member of the firm of Nyemaster,Goode,Voigts,West,Hansell&
O'Brien, with offices at 1416 Buckeye, Ste. 200, Ames, Story County, Iowa. I further state that I
have examined the Abstract of Title to the following-described real estate, to-wit:
A tract of land located in the South Half of the Northwest Quarter
(S'/z NW'/4)of Section Twenty-eight(28),Township Eighty-four(84)
North, Range Twenty-four (24) West of the 51h P.M., City of Ames,
Story County,Iowa,described as follows: Commencing at the Center
of said Section 28, thence S89°50'58"W, 1385.40 feet along the
Southerly line of the NW'/4 of said Section 28 to the Point of
Beginning;thence N00°07'32"W, 149.91 feet;thence N89°52'28"E,
129.00 feet;thence N00°07'32"W,666.00 feet;thence S89°52'28"W,
195.00 feet; thence S00°07'32"E, 49.00 feet; thence S89°52'28"W,
130.00 feet; thence S00°07'32"E, 42.00 feet; thence S89°52'28"W,
185.13 feet to a point on a 472.50 foot radius, non-tangent curve,
concave Westerly; thence Southerly, 10.99 feet along said curve
having a chord bearing S00°47'32"E, 10.99 feet; thence
S00007'32"E, 20.23 feet; thence S89°52'28"W, 130.00 feet; thence
S88020'41"W, 106.14 feet;thenceN84°36'08"W,212.00 feet;thence
N81024'43"W, 117.30 feet; thence N55009'49"W, 138.51 feet;
thence N23°35'12"W, 139.19 feet;thence N01°25'30"E,222.36 feet;
thence S89°23'03"W, 123.22 feet to a point on the Westerly line of
said NW'/4;thence S00041'37"E,583.69 feet along said Westerly line
to the Northwest corner of a triangular tract described in a deed filed
January 3, 1964 in Book 96,Page 80 in the office of the Story County
Recorder; thence S54°23'45"E, 982.64 feet along the Northeasterly
line of said parcel to a point on said Southerly line of the NW'/4, said
point being the Southeast corner of said parcel;thence N89050'58"E,
426.72 feet along said Southerly line to the Point of Beginning;
containing 18.52 acres subject to easements of record,
from the root of the title thereof, down to and including the day of
2001, last certified by Abstract & Title Services of Story County(Iowa
Title Guaranty Division Member #8650). The real estate has now been subdivided and is now
known as NORTHRIDGE HEIGHTS SUBDIVISION FIRST ADDITION,STORY COUNTY,
IOWA.
Based upon information within said Abstract of Title, it is my opinion that the fee
simple title to said real estate is in Uthe Development Company,L.L.C. The real estate is free from
encumbrances. The property is further subject to easements and restrictions of record and to zoning
ordinances of the City of Ames, Iowa.
