Krauth,hereby state that I am an Attorney at Law,duly admitted to the practice of law in the State of Iowa,and a member of the firm of Nyemaster,Goode,Voigts,West,Hansell& O'Brien, with offices at 1416 Buckeye, Ste. 200, Ames, Story County, Iowa. I further state that I have examined the Abstract of Title to the following-described real estate, to-wit: The Southerly 60.00 feet of the Westerly 1625.46 feet of the South Half of the Northeast Quarter(S'/2 NE'/4)and the Southerly 60.00 feet of the Easterly 1385.40 feet of the South Half of the Northwest Quarter(S'/2 NW'/4), all in Section Twenty-eight(28),Township Eighty-four(84)North,Range Twenty- four(24)West of the 5th P.M.,City of Ames,Story County,Iowa,containing 4.15 acres inclusive of 2.67 acres of existing right-of-way by easement, from the root of the title thereof, down to and including the 20th day of July, 2001. Based upon information within said Abstract of Title and Report of Title prepared by Abstract and Title Services of Story County(Title Guaranty No. 8650), it is my opinion that the fee simple title to said real estate is in Uthe Development Company,L.L.C. The real estate is free from encumbrances. Dated this 24th day of July, 2001.
